i just got a reply already

    "Hi Tim,
I am glad to inform you that we have listened to our members and first of all we have removed the VCS from our Wigan club. I can also now confirm that any charges against yourself are now void, If you receive any further communication please ignore as the charges against you have been dropped.
I would like to take the time to apologise for the inconvenience caused and the length of time this has taken to be resolved, but communications with the VCS had taken much longer than initially expected.
Thanks for your patience in this matter, if you require any further assistance please do not hesitate to contact us back, we hope you enjoy your time with Xercise4less.

    Kind Regards

Not that I can recall but I expect you aren't the only one, if Tlg1991 has also had a wrong car reg piece of 'evidence' and the Excel GPEOL list instead of the VCS version! It's certainly sloppy and a data protection issue as you say. Also report them to the BPA as they can get sanction points from those complaints - data protection is covered in the Code of Practice.

i received my evidence pack for 2 POPLA appeals now, one of mine has the wrong car reg on under the exemption list part but has my car on the pictures in other sections.

Also the pre estimate of losses statement has the header for EXCEL parking and not VCS. the second pack they have sent me is all "correct" so not to sure what to do to be honest. i don't want to just ignore it, i will stress myself out just in case.

Point out those anomalies by email to POPLA now - you can respond & rebut the 'evidence packs' and there are several very current Excel & VCS threads talking about the sort of thing to say to POPLA if you do email your final representations in the light of the drivel you have been sent. You can also attach, for POPLA to read, the email from the principal (the Gym) as further evidence and say you cannot understand why VCS are trying to contest a charge which they have 'agreed to void'.

I am pleased to see what has been achieved - a 5 year contract in the bin after just a few weeks, due to customer complaints. Marvellous to read of VCS being run out of town!

Didn't VCS jump-ship to the IPC? If yes then pointless complaining to the BPA about them. ;)

No because this all occurred before they jumped. So the BPA can investigate and liaise with the IPC. Any sanction points carry forward to the IPC (we know that as fact - the DVLA have stated as much).

I got a response off BPA as follows:-

    Thank you for your e-mail.

Please be advised the BPA are not a regulatory body and therefore this type of complaint is outside of our remit.

Your complaint would be best dealt with by the Information Commissioner’s Office. I have provided their website below for your convenience:

I am sorry we cannot offer any further assistance in this matter.

    Kind regards,

Interesting and wholly unhelpful. Was that from Gemma Ridgewell at the BPA? You could send the same complaint to the IPC attaching a copy of the BPA reply and asking - so the BPA are telling me that a serious data protection breach isn't something they want to know about and as such VCS have escaped to you, scot free of any sanction points for this particular issue which in fact happened only last week so was admin carried out at a time when VCS were under you as their ATA. The parking event was when they were with the BPA. Am I really to believe neither ATA are interested in this matter? In addition these PCNs at this site have all been 'voided' by VCS and the Gym and I have proof in the form of an email so why are VCS contesting and continuing with them?
