Down in Portsmouth

As well as our house in London, my wife and I own a property in Portsmouth. Because it is almost opposite a major shopping centre and close to the IoW ferry terminal some parking enforcement is necessary. It is a private estate run by a Management Company on behalf of Trustees.

My wife recently got a new car and mistakenly put her old (last year's) permit in the car. Today (the first time we have been down there since she got the car) she got a ticket.

Can I just 'fight' it on the basis that they (Capital to Coast) have no actual loss, or is there something else?

    LOL! C2C are based near me in the Brighton area. Trouble is they are with the IPC which means you have the lottery of Mr Hurley's so called IAS ahead of you (not POPLA). Search the forum for Capital2Coast (with the numeral not 'to' in the middle) and also search 'IAS' as a keyword. NOt as easy as POPLA and almost certainly NOT winnable on 'no GPEOL' unless they have old BPA signs up from before the bed-hopped!

    Show us the signs.

    Wait for the NTK without a doubt. NO APPEALING EARLY TO AN IPC MEMBER UNLESS IT'S A COMPANY OR HIRE CAR.

    Know the area well. Near Lipstick Tower. C2C inherited/bought the contract from a rather more infamous outfit - Shoal Enforcement - they who were involved in the clamping of the police protection team when the queen visited Gunwharf Quay.

    C-M is very much on the money. Wait until C2C send you a letter which they may or may not call a Notice to Keeper. If they are going to adhere to the requirements of the Protection of Freedoms Act then that should arrive between Day 28 and Day 56. If it is sent before or after that time then POFA is not fulfilled. I suggest that you get photographs of the signs.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Thanks to you both. I will be back down there at the weekend when I will photo the signs. It does say "a valid permit", and I presume last year's is no longer valid.

    I have e-mailed the estate Management Company, but unfortunately the contact there is on holiday!

    BTW We are across the road from where HM's car was clamped !

  • Well things have moved on today! My wife got another ticket ! This time for 'parked on the roadway'. Outside our house there is a sort-of bay, basically if you drive in and try to carry on you would drive into a flower-bed! So therefore it can be used for nothing but a parking bay.

    However, in the meantime the Property Management Officer's Admin Assistant e-mailed for the FCN number so she could get it cancelled. Obviously I sent it to her, with the second one as well.

    But when I originally complained to the PMO I thought the first ticket was because the new car hadn't been registered (didn't think we needed to register it anyway), and therefore suggested that the displayed permit was valid. She maybe more reluctant to get it cancelled when she reads (I sent a second e-mail) that it was an out-of-date permit.

    I will have to wait to see what happens.

    If one or both tickets don't get cancelled, and we cannot with 'no GPEOL', is it worth going for early payment ? (Haven't had time to check other threads, yet).

    You need a not only show the wording of the signs, but if the signs are some significant distance from the car this would be relevant too, as would any markings etc.

    But don't get another ticket while you do it!

    There are many signs around the estate. It is very difficult to miss them, even though there is not one directly outside my house, there are at least two across the road.

    Yes but at the entrance?

    And it depends on the wording - it's imperative to see the sign for an IAS appeal and to WAIT patiently a month before appealing only as keeper to the NTK.

    Your other option would be to pay £16 to ParkingTicketAppeals to handle it, guaranteed. They appeal IPC ones earlier (different method) so you'd need to contact them soon if wanting to hand it over to them and wave it goodbye.

  • I have just heard from the Property Manager Administrator (where do they get these titles?!) that she has asked C2C to cancel the two parking tickets.

    Is there now any point in taking and sending up the photographs? I have asked for clarification that it is in order to park outside our own premises.
