solicitors letter

After a bit of advice please. Received a solicitors letter recently for non payment of pcn that occurred nearly 2 years ago. The amount now due is ridiculous and the threaten of court action if it's not paid in next 14 days. I am a bit wary of putting too much info on here but have received about 4 or 5 previous letters a while ago which I just ignored and don't even think I kept them. Not really sure what to do now as have now seen that ignoring is not the best option. Any help would be much appreciated.

    My guess UKCPS and Miah.

Answer to OP = search the forum for 'Miah' as the obvious keyword, as we can't cover this ten times a day - there are sooo many threads about it you can find in a second with a search of one word.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

  • Correct on both fronts. Tried searching but couldn't find much on what to do after reforming solicitors letter.

Search for 'Miah' and change the default search to 'show posts' instead of show threads. There are threads galore this week including one where UKCPS cancelled when they saw the response we suggest. I won't post links as it doesn't help newbies not to get used to how easy the forum is to search to find what you need.

  • Some scummy solicitors will happily send out any letter on their headed paper that the scummers can cobble together..... for around the £2.50 mark.

Some people panic when they see 'solicitor' at the top and send off the money to the scamming scum.

This would be my reply to the solicitors:

    Dear Sirs,

I have received your letter of the XXth requesting payment of £XXX on behalf of your client.

In order to become qualified as a solicitor, I assume that at some point in the past you would have studied for, and graduated with, a degree in Law, and that the course syllabus included Contract Law. You will therefore be fully aware that the potentially fraudulent, and utterly baseless demands for 'parking charges' made by private parking companies do not represent any genuine pre-estimate of loss, and are in fact unlawful penalties which would not be recoverable through civil litigation.

It is commonly believed, by members of consumer advice forums, that firms of solicitors who act on behalf of such organisations are either bent, or desperate. I am unsure as to which category your firm falls into.

You may rest assured that I shall not be paying a single penny to your client, unless and until ordered to do so by a District Judge, or when Hell freezes over, whichever occurs first. No further correspondence will be responded to on this matter.

    Yours etc.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
  • Am actually very tempted to write something like that bargepole.

After reading the many posts on Miah/UKCPS I am still unsure if my letter counts as a LBCCC. I have been offered 14days to pay the amount shown & if its not payed they say 'we may issue legal proceedings without further notice'.

The offence was for parking in a disabled bay without displaying a BB. The driver at the time had a registered disabled person as the passenger but forgot to put it on the dashboard. The carpark is a free to use, no ticket to display type of retail shop one.

Should I treat the letter as a LBCCC, just ignore or send some sort of letter back to them?
  • The clue is in the words "we may". It's not a LBCC, it's just them acting as debt collectors.
  • Ok, fair enough. It was just that the letter was signed by a character who is part of the litigation team. Is it best to ignore again or respond then?
