The Miah Solicitors (a trading title of The Miah Solicitors Ltd) is something of a misnomer in that there is only 1 solicitor in the firm - Sufe Miah.

Is Ian Brill not a solicitor?

The Law Society lists regulated staff at Miah's (along with all regulated firms). They list just the one staff member - Sufe Miah.

Ian Brill is registered as an individual solicitor but is not recorded as having a "role in an organisation". He may indeed work as a consultant but he is not on the staff.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

As I am but a simple country lad you will have to explain to me {in words of one syllable please) the difference between what you said,

Ian Brill is registered as an individual solicitor but is not recorded as having a "role in an organisation". He may indeed work as a consultant but he is not on the staff.

    and what the website says.

Ian Brill is a former partner of a large Leeds based law firm who is a full time consultant at The Miah Solicitors. He has been qualified for over 30 years and has vast experience and knowledge in his areas of expertise.

Anyone with vast experience would not be putting their name to threatening people for debts that do not exist.
Having your name linked to such an outfit as a PPC is not the best way to improve your profile in legal services.

In fact I would go as far to say, it is probably the quickest way to make sure nobody trusts your name in the industry ever again.

Would you trust a solicitor who sends threatening huff and bluff letters on behalf of a PPC to do anything if they have such a poor understanding of case law and will send letters to the contrary of the principles ?

PPC's, admittedly have had some success in the County Court, but this is for two reasons, the county court can ignore case law and they have not bumped in to anyone who has taken them beyond it yet to a higher court where it must be weighed as evidence.
As I understand it, this may be about to change.
All I can say is this guy must be past desperate, well past.
I do Contracts, all day every day.

Why don't you just look for other threads like yours, e.g. adapt Blissikins' letter which worked? That poster took the advice we've given you already. i.e. they read zzzLazyDaisy's thread about responding to LBCCC letter and adapted a version to suit - and UKCPS folded.

And before any newbie asks, no I won't be linking Blissikins thread seeing as it's easy to search for and is right here, right now, near yours! You could add the question to a robust response: ' When replying, I require an answer to the following question: are you acting as a litigator or a debt collector? I believe the latter due to the flimsy notepaper and wording template sent to other people which is already in the public domain. Speaking of domains...I suggest you check yours. ' !

Solicitors who register (and they must do if they are to practice) must disclose who they are employed by if they are employed by a firm or act "in-house" as it were - such as the fragrant Ms Ledson does at ParkingEye. If they act on their own - that is they are not employed by a firm - then their registration appears, in effect, standalone and the are not linked to a firm. This appears to be the case with Mr Brill.

I note that Mr B was the sole solicitor at his own firm (Vaughan & Co) which was "taken over" by Miah's in June. That his registration is still, perhaps, "in progress" (although any reference in his registration under Vaughan & Co is already absent) is I think unlikely. It is more likely I suggest that he is "working his time out" as part of the takeover. Perhaps after 37 years as a solicitor he might be wanting to hang up his briefs.

  • Hi.
I've had exactly the same letter from the same people, Re: the same claim....only difference is that I AM disabled. The car park in which I parked, can only be exited if you have paid for/ validated your ticket ( secure barrier exit), so I have not only paid my parking fee, but got a ticket for parking in a disabled bay without displaying the 'proper' blue badge.....this is somewhat true, as I had just received my new one, but displayed the out of date one by mistake.
My issue is, that I remain no less disabled after 12 years of Parkinson's and in date/ out of date blue badge is a mute point, as the bays are 'reserved' for the disabled..
I phoned to complain to UKCPS about the original ticket, only to be told to photocopy my new badge and send it to them. On enquiring with the issuing body, I was informed that it would be illegal to photocopy it, and more so to ASK for it to be....so as per thread advice here, I did nothing
    Should I contact this solicitor?
    .....sorry to hijack thread...

I note that an Ian Brill was mentioned in a boiler house scam in July 2011, but have no reason to connect him with "our" Mr Brill.

  • Just an update for the people following the thread. I spoke to the head office of the gym chain this morning and they stated they will try and get the issue resolved for me. Meanwhile I have just finished my letter, quite similar to Blisskins letter but changed for my specific case. I have also included the - which process are they operating under debt collector or litigator. I will be looking at sending this out to them at some pint today or tomorrow and just hope that they drop the charge.

Of course you must - I already said what to do and it's already covered in Blissikins thread. I won't link it - newbies need to read other threads and search & find things on the forum easily, to get the help & read the relevant stuff they need. Use this forum well - including 'search this forum' for keywords like 'Miah' or 'UKCPS court' and you'll find everything you need including if you have to defend at a Court hearing.

Please then start your own thread but ONLY after drafting your own version of a response based on what you see in Blissikins thread and zzzLazyDaisy's 'LBCCC Fightback' sticky thread (one of those linked by Crabman near the top, in his 'Parking forum stickies').

No more hijacking this thread please. The quickest way to hop back to page one with the sticky threads at the top is to use the 'Forum Jump' (click GO) bottom right of any page. So Forum Jump back to square one now and find Blissikins' thread and Crabman's parking stickies where you then click on zzzLazyDaisy's 'LBCCC Fightback' thread. If you end up with lots of tabs open, remember the Forum Jump. :)
