With any solicitor, you can start ramping the bill up for the other side by asking certain questions they are obliged to answer under SRA rules.
Here is a good one, Dear Solicitor please can you clarify under what process you are working.
Litigant or debt collector
(if they have asked you to pay them the money) As you do not appear to be registered with the Credit Services Association so I am slightly confused why you are acting as a collection agency when you are not a member.
I shall also ask the SRA and the Credit Services Association to clarify the situation as to which hat you are actually wearing.
The debt collectors hat or the litigants hat.
I await your response.
This will be good, get a seat and a drink ready.
So do you rekon its just an outfit for a scamming people out of their hard earned cash?0 -
Other than there wasnt any other free parking spaces available No.
Thanks for clearing that up. Had you had a legitimate reason under the Equality Act 2010 there would have been options open to you to fight this under that Act.
While we will help you to try to resolve your issue with UKCPS/Miah, you will get no sympathy from anyone here for your abuse of a place specifically reserved for those with need.
Parking in disabled bays by people with no need of them is one of the reasons landowners call in PPC's - and UKCPS 'specialises' in booking disabled bay 'abusers'. They are also litigious, so you need your 'A' game in dealing with this. You need to head this off before they issue court papers, because you'll have your work cut out to convince a judge that you had a right to park there and argue the point from your opening thread.I did read somewhere on this forum that parking on a disabled bay in a private care park - does not require you to display a blue/disability badge and therefore the penalty is no enforceable?
What you quote is correct about there not being the need to display a BB, but this refers to people who are covered by the EA 2010 who do not qualify for a BB, not anyone who just wants to dump their car in a disabled bay.
That's the rant over, now we'll get on with trying to see you through this. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Dodgy (or not) won't resolve this for you. You need to find out in what capacity they are operating (as per Marktheshark's post).
If they are operating in a debt collector capacity, standard forum advice is to ignore any communication from them as they cannot issue court papers - only the PPC or the landowner (or solicitors acting on their behalf - and there's the 'rub' and why you need to determine their capacity). If acting as a standard debt collector the only thing you should not ignore is a Letter Before County Court Claim from the PPC (or, unlikely) the landowner. Please read NEWBIES FAQ sticky post #4, about how to deal with debt collectors.
If however they are acting as litigants (on behalf of UKCPS or landowner) you should probably consider their letter to be a LBCCC and in which case you should read zzLazyDaisy's advisory in Crabman's sticky (top of the forum index) which will tell you how to deal with a LBCCC - Daisy is a retired solicitor, so her thread is soundly based legal advice. The same advice applies should Miah not be acting as litigants, but you receive a LBCCC from UKCPS.
Two other things for you to do is:
1. As the term 'contractual charge' is mentioned in the letter it would be wise to get photos of the UKCPS signs at the gym car park. These will be important for dealing with 'contractual charge' allegations. Host copies of photos on Photobucket and post link on this thread but change http// to hxxp// and we'll do the conversion (newbies can't post working links).
2. Have you complained about this to the gym, that their agent is harassing a customer with solicitor letters and threats of court action? I'm presuming you're a member there, so how about hinting that should this charge proceed, there are plenty of other gyms where you can clearly take your custom.

There was a windscreen ticket, a quite scrappy looking one which I just regarded and I believe I did receive a a further correspondence several weeks later which I also ignored. I have been using the same car park for a few years now and have often received the same type of windscreen tickets however this is the first time I have had a letter from a solicitors firm. The reason I initially parked there was that the gym car park usually has no free bays at approx at 5-6pm and one has no alternative but to park in a disabled bay.
(
Not my place to judge, and im all for fighting this fake ticket but if there is ever a morally questionable type of parking, even on private land, its using disabled bays when you are not.
Especially for a gym; park further away and jog there as part of your warm upLeft is never right but I always am.0 -
