I have also escalated this to Barclaycard and was simply advised to refer to firstchoiceepcs terms and conditions I was told that I needed to allow 28 days to pass before raising a chargeback as only then would I be successful in my chargeback ! I am fuming with this but I have to be so careful with a regulated role I am in I am going to pay then will seek advice to try and get all my money back and more if possible. Let me know how the email to the CEO goes as I have lost all hope with Barclaycard I thought they were meant to look after the customer!!!!0 -
Please do not pay, pure and simple he is threatening to try and get you to pay, and it seems in your case he is succeeding. Thats exactly how he plays this game, he knows some people will cave in.
Do as I say and write to the CEO of Barclaycard, I beleive they have a resposibility to look into a reported scam and not simply fob you aff and tell you to refer to the terms and conditions, they have a special department that looks into scams and fraud, tell them that you have been told to refer to his terms and conditions, without barclaycard even giving a damn to look into this themselves, Tell them he is bieng investigated by the police and even a member of Parliament is involved (refer to the article in one of the links, tell them that his terms and conditions are illegal and he is breaking regulations, again refer to the article, this in itelsf is enough to mahe the contract unenforceable. It makes me mad when big companies just fob people off like this.
An email will take you 30 minutes to write.
There is one reason this guy has never taken anybody to court to try recover any money yet, and thats because he will be torn apart by the judge and loose. There is also a reason they he is impossible to track down and find, and thats because if he is then he would be inundated with county court summons himself, the only reason I didnt send one to him is because I cant find where he is, and it would just waste more of my money.
If you pay any more money to thius guy you will never see it again, and he will be laughing all the way to the bank ..
1 letter to a CEO will generally sort out the issue once and for all.
If you are worried about your job, I would speak to your boss and tell him of the problem, and refer him to all of the links I put in the other message to you.
This is a UK company, with a german hosting website, run by a South African front man in a registered serviced office that nobody ever goes to with a correspondence address in Spain .. there is a reason he has a correspondence address in Spain, and thats because its highly unlikely anybody is going to send him county court summons there, and if they did, who is going to enforce them, the Spanish government are definately not.
One last point, for you to get a bad credit, he has to take you to court to try recover the money and WIN, just going to court does not give you a bad credit, and even if he won the case, which he wont, you then would have 30 days I think to pay up, and not receive a bad credit, within all this time you could settle with him if you wanted and not receive a bad credit.
Its threats of bad credit that this guy lives on ...
Its been 6 weeks since he told me he had started court action and to stop it I had to pay up, and I have heard nothing, this is this guys last bullet in his gun, after that threat he has nothing.
If somebody legitimately owed me 500 quid I would sure as hell make sure they were in court the next day, not wait for months.0 -

I can confirm from personal experience that epclocal (and any other name they go by) are just a con. they took my money without permission (having promised to only charge on the day) and then I never heard from them again. I have sent several emails but they either respond with a one-line email that suggests my response has been dealt with (which it hasn't) or they don't response.
the epclocal website is merely there to take fees it has no intention of ever delivering on.0 -

I have now received a notice that they intend to claim the money that I 'owe' them through the County Courts. Interestingly, when I argued that I had never cancelled the service, they argued that ordering another EPC from another energy assessor 'prevented them from supplying the contracted service' to me, and served as a cancellation!
I have also sent them an invoice, since the terms and conditions on my website state that if anyone connected in any way with First Choice EPC contacts me in any way, they immediately become liable for €627.35. Failure to read the terms on my internet site is not a defence…
All very annoying. I am a journalist - do you think I should see if any newspapers are interested in this story?0 -

What I will say though is that I am indeed helping somebody who has received a county court summons from first choice epc, and these are the facts that I am sure firstchoice will confirm here.
As first choice has a correspondece address in Spain which is not dodgy at all (sarcasm), and as we all know their serviced office turns away registered post there was no way for me to get an address to send a court summons to them, so after several of their threatening emails, twice I invited firstchoice to send me a court summons.
I asked for this for 2 reasons, the first reason was that it would be the only way to get an address that I could use in a court case – mission accomplished, the second was so that I could then make a claim or more specifically a counter claim against thair claim, which now has been done, this counter claim includes the original fee of 39.99, the court costs, and I added an extra cost for time I have spent dealing with this.
I would urge ALL and ANYBODY who receives a county court summons from firstchoice to make a counterclaim as above, and dont forget to add “compensation cost” for whatever amount you think would be appropriate.
I am sure that firstchoice will now confirm to everybody here that they have indeed received a counter claim from one of their customers.
Anybody that has RECEIVED a court summons from firstchoiceepc I would like you to contact me if you can, I can tell you what to do and give you some information which you can use. I will set up an email address and post it here so that you can contact me directly, I will need proof that you are who you say you are, and also proof of the court summons as this is now a legal matter. Hi all , like most of the posters on this thread I have paid for a service from this company that I have not received. I am going down the route of trading standards as well as a complaint of fraud to the insolvency service. Maybe if the insolvency service and trading standards had complaints from everyone who has had a bad experience from this company they may actually investigate and take some form of action.
Will keep you updated to how I get on.

Oh I forgot to mention ,in case any one from firstchoice epc reads my previous post don't waste your time threatening debt collectors or court action, been there worn the tee shirt with great success on a number of occasions in fact some say I enjoy the fight especially when collecting money from the instigators .
