My thoughts exactly.. I purposely didnt tick the "do you want mediation" box in the summons purely because I want this to go all the way
.. and thats for a specific reason which first choice will soon find out

The answer you are looking for is in post #85.
Thi isnt exactly true, and doesnt work all the time, Barclays for example are useless, I started a chargeback claim at the begining of december and they still didnt get the money back, but I did get then to give me £39.99 as a "good will gesture".
Barclays excuse was that it is up to the merchants bank to decide if this company is pulling a scam or not. And of course we know what the merchants bank will say. (I am not saying all banks are the same, and this is the first line of attack that anybody should take.
The only way to be sure you get your money back is to make a claim against this company in the small claims court .. google "moneyclaims online", of course firstchoice are relying on people not bothering because they think that £39.99 is not worth the time .. but it is worth the time for 2 reasons, the first is to get your money back, the second is that it will give you some experience in how to take companies like this that rip you off to court in the future. I use moneyclaims online all the time if I get issue's like this.
This is the address to send claims to
Firstchoiceepc
Flat 30, Marylebone Road
London
NW1 5PH
Any other address like for example his correspondence address in SPAIN !!!!!!!, and his registered office that is merely a serviced office that letters sre never answered or signed for will get you no where.
And this has been confirmed as the address only for court papers by Mike Cox from firstchoiceepc
Check out post 80 here http://www.housingenergyadvisor.com/blog/is-first-choice-epc-worth-the-risk/
It will cost you £35 (just check that figure though) to take firstchoice to court to get your money back, but you can add onto this the court fee and also any compensation that you feel is adequate for the time taken, phone calls and emails written, and stress that their lack of customer support has cist you, but be reasonable (unlike the unreasonable charges firstchoice seem to like to screw out of people)
I am currently in touch with several people now with reference to court proceedings against firstchoice.
You can get in touch with me here firstchoiceepcscam@gmail.com if nessessary. I will need proof of ID before I will give any advice or information though.
And the most important thing of all , believe NOTHING that mike Cox or firstchoice tell you either here in a forum or in an email or any other contact, they rely on misdirection to try make you back off.0 -
Hi kev, just adding some more info that you probably know but other posters may not about court charges, remember to add your parking costs, your travel costs and also costs of your time researching the court case at around £10per hour but as Kev says be reasonable as the judge is the one who decides whether or not to allow your costs.
On another note spoke to trading standards & consumer direct today who were very interested in firstchoiceepc especially the terms which a lot of is according to them unlawful and as they were on the site reading it there selves I guess must be correct, they also kindly told me the regulations that they believed we're being broken and which to quote within the cancelation letters to be posted to the registered address and the correspondence address by recorded delivery so that a paper trail is available to show the judge if court proceeding are started by either party.
And I have only just begun my quest to bring this firm to justice lol.

Hi I paid a £40 fee one month ago but have heard nothing . Has anyone actually had an EPC from this firm or is this one big scam?0
-
It is most definitely a scam.
If you can stop your payment and find another EPC company.
You will get lots of threatening emails from them but they can't do anything.
I'm currently waiting for them to take me to court for not paying the £439 they are charging me for an EPC they never provided.
If they ever do (which I doubt as that's when it starts to cost them money); I will get my solicitor (my sister) to look into claiming costs from them for causing my house sale to fall through.0 -
All I am going to say about any court issue's is stay tuned
