    Absolutely cracks me up that people can afford to run a car and mobile phone but are too tight or thick to spend £30 on a hands free kit, they deserve everything they get and more in my opinion

    If the OP wishes to post on a public forum a topic where they face prosecution for using a phone whilst driving then it is likely they will not like some answers they get... So if that's the case then why not speak to a lawyer? It's penny pinching that got them into the mess in the first place...


    Besides, I don't think I said anything judgemental about his wife so suggest you take your moral high ground somewhere else.

    Yes. Mobile phone use while driving should result in severe punishment.

    Moving on from that point, the authorities also need to follow proper procedure and not randomly do stuff at whatever pace and process they feel like.

    If there is a time limit to be followed, then it must be followed, or the penalty/punishment is invalid.

    Since they gave her a verbal Notice of Intended Prosecution at the scene, they do not have to send the paperwork within 14 days if I remember correctly.

    They have upto 6 months to file a case in court if needed, it need to be heard within 6 months.

    Why would the police inform anyone of the likelihood of prosecution twice?

    The police at the time of stopping the OP's wife probably said something like "You will be reported for consideration of the question of prosecution for the offence of ......'

    There is no point in sending a written NIP as a verbal one has already been given.

    A letter saying whether any prosecution will actually go ahead or not is what the OP's wife is waiting for - i.e. the decision after consideration.

    Quite rightly there is virtually no chance that it has been 'forgotten'.

    We have all witnessed examples of uncontrolled vehicles, and not all or even the majority involve mobile phones, that is not to say the law guidlines are not correct.
    I see many drivers with children in the car driving without full attention to the road and conditions around them.
    But for the stats for the preachers, figures suggest 3% of accidents are caused by Drink or other intoxicants , 6% by use of a mobile device and 11% by young drivers, so the other 80% must be caused by middle age sober drivers? :eek:

    They as well as other readers are interested to know the answer, it doesn't mean they are trying to wriggle out of anything, perhaps they wish for the episode to be concluded quickly.
