Caught on the phone while driving

I wondered if anyone could give me a quick answer as I can't find it on the web.

My wife was caught trying to make a call while driving. A police car stopped her and spoke to her and said she would receive a letter explaining what happens next. he incident occured in early August and we believed it was forgotten, but the a letter of penalty came in today.
With police cameras the law says they have to serve you the notice in 2 weeks but is there such a law for phone use?

    Wasnt she served notice when they stopped and informed her a letter will be sent with the penalty?

    Watching some of the latest police shows and it seems they dont give you a ticket there and then. They say the ticket office? decide on the penalty.

    You maybe offered a fixed penalty or a day on a course instead.

    It's not to do with phone use, but with the fact that she has already been told by the officer that she would be reported.

    A written Notice of Intended Prosecution (NIP) is not needed in those circumstances.

    That's' correct, also a mobile phone offence does not require a NIP.

  • And expect 3 points and about £100 fine (plus a probable rise in insurance premium as a lot of insurance companies are taking a dim view of mobile phone offences now)
  • I have to say I hope she does get three points and a fine. Why do people think the law and the safety of other users doesn't apply to them?

    You're wife should be ashamed of herself........mobile use while driving is as bad as drink driving IMO...
