OP, I believe the others are right in that the police don't need to send a letter. However, your wife did break the law and should be punished in some way.

I'm guessing your wife makes calls from the car as a matter of course and views herself as unlucky?
As a daily cyclist I see people that carry on like your wife everyday...
Perhaps this is the wakeup call she needs before she kills somebody?0 -
I haven't seen many folks charged with drink-driving come on here asking for advice - probably because they know full well that they will be castigated and get no sympathy whatsoever.
The use of a mobile phone while driving has not yet reached the same status as drink driving - but is just as dangerous.
The penalty should be increased.0 -
With a six point penalty a second conviction would be a driving ban. I suspect most motorists would support that.0

Mobile phone use in cars has been proven by numerous researchers to be as or even more dangerous than drink-driving in many cases, and as a result it is absolutely correct that the perpetrators be punished heavily.
Having been punted into NSL traffic on a roundabout at which I was waiting stationary on my motorcycle by a phone-using driver (an incident which could easily have killed me had I not seen it coming and hence been prepared for it), I too wholeheartedly support the notion that the penalty for phone use should be MUCH more severe than a few quid fine and a few points.0 -
Whilst the sentiment behind the use of a mobile phone at the wheel is understandable, the purpose of the thread was to ask about the prosecution procedure, not a public outcry Daily Mail style.
The legal procedural aspect was answered by the 5th post, thereafter the just and moral brigade have had to wade in.
This forum must only contain the small section of society who have never made a mistake, or committed even the slightest faux pas in their lives, well done you! Mummies special little soldiers.0 -

The query the OP had was answered as Oman had also observed, which was answered much earlier in the thread as the OP had observed and much quicker than seeing a legal rep.
There was no plea to the readers of any mitigating circumstance, there is no indication that the OP and his partner are not going to take it on the chin, so as others have observed, and I agree, I can't see what all the moral preaching is about?0
