Capital2Coast Fine

Any advice someone can give would be appreciated. I know there is a lot on here but there's so much I don't know where to start.

Ill finish off my pasting here my appeal further below as that explains the situation. Basically I received a Notice to Registered Keeper almost 2 months after the incident, when I was parked there fore only 3 minutes and when the attendant was next to may car and didn't say anything upon my return, had not put any notice on my car and appears to have given me no grace period.

Any advice on what I said to them or how I could appeal if they turn me down.

I have a number of concerns around the circumstances of this fine, some of this may be repetitive and I am sorry if that is the case but I want to ensure I get my concerns across properly:
(1) I was shocked to receive this notice. This is related to the incident on 18/7/14 - and then issued 8/9/14 - I question the delay.
(2) However having received the notice I remember this very well and would like to explain what happened. I parked there, as all of the bays outside Tesco's were blocked by their delivery van. I also parked there as I presumed those 2 bays were for the Brighton and Hove Council offices which were cleared out and have remained unused for some time. Also, my focus was on the Brighton council sign about the parking not your sign which I did not read, the Brighton council sign is what caught my attention so there was no need to look elsewhere to check. I never thought for a second I would be given a fine therefore by the council (which I presumed at the time it would be) to park somewhere for 3 minutes.
(3) I parked there for 3 minutes as all I needed was some milk and I was in a rush for work and there was no cue at the self service counter therefore I knew I wasn't long. I am sure you can imagine my shock when after returning to may car I saw your attendant standing next to my passenger door, talking to someone in their car next to me. She must have seen me park there.
(4) Can you explain why she did not say anything to me and why she still chose to give me a fine. I was gone for 3 minutes and she said nothing to me upon my return nor did she leave a fine on my car.
(5) The above I believe goes against best practice in terms of fairness, ethics and the IPC's code of practice.
(6) The notice was processed 1 minute after the photo was taken, I did not see the attendant do either. Considering how long I was gone, I can not get around in my head how quickly she must have done this.
(7) Why did she not wait for 1 minute, why was it done so quickly, did she watch me park and if so why didn't she say anything. I never saw her myself, was she hiding or waiting for people to park there and fine immediately, without giving them any grace period whatsoever.
(8) The Code of Practice talks about the need to give drivers grace periods. My situation shows that no grace period was given whatsoever.
(8) Code of Practice talks about when notice's to drivers are not paid...and the subsequent issuing of notice to keepers (and reason why you accessed my details from the DVLA) - but you never issued me with a notice to driver in the first place.
I am sure you can appreciate why I am so disappointed. New laws were brought into account only a few years ago to make sure best practice was followed in terms of fairness for both the land owner and people like myself and I feel what has happened in this situation goes against all of that. There was no need for me to be issued with a fine, I was parked for hardly any time and considering how quickly the photo and notice was processed I can only presume someone was lying in waiting which is also against the Code.
I hope you will understand and reconsider your fine.

    To start with, can you clarify if this is a legit ticket, issued on behalf of a council, or a private invoice (which is not any sort of fine!). It should say so/who to pay to on the ticket.

    IIRC this lot do (or did) have a few legit contracts.
  • Sorry I shouldn't have used the word fine. It is a "notice to owner" as the registered keeper. I never received any initial notice to driver or anything else.

    Edit your post to remove any reference to the driver.

    They are not POFA compliant, so can only pursue the driver

    You need to carefully read the Newbies Sticky and particularly post three, which points you at how to do an IAS appeal.

    Well, assuming that the bulk of the post was OP's appeal to the PPC, you can forget POFA re keeper liability.

    Sorry, xeenies, but you have thrown away much of your possible appeal points with your initial appeal and IPC are hard enough to win without gifting it to them.

    It is a shame you did not find us sooner, as the NTK was non compliant and would have won the case for you.

    This will almost certainly get rejected.

    Your appeal points will be very limited now.

    Predatory practices may be one.
    Signage may be another

    It in all honesty you have given the game away and blown many of your chances as previously said.

    Fingers crossed someone feels sorry for you!
