They won't want a Judge to see that.

Which is, in my view, why appeals to IAS are actually worth it.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I had posted the results of my IAS appeal on here, but then panicked and removed it, as the IAS email had a load of threats forbidding copying, reproducing, etc. When I read through properly though, it only said that if you are not the intended recipient then you can't copy, reproduce etc. So as I was the intended recipient, I decided 'publish and be damned' and sent to Parking Prankster who helpfully stuck it on his blog :)

Thanks to everyone's help & advice, I've now sent letters of complaint to IAS (about the adjudicator), to DVLA (about IAS and Excel) and to the SRA (about IAS). Not expecting any joy but at least I feel as if I'm trying to do something, rather than sitting back and letting them bully me. I've set up another thread specifically about the car park in my case, hopefully to help other people who get stung there. I'll update this thread if I get a response from IAS and/or DVLA and/or SRA .

    Cheers

Good stuff :) Enough complaints and something might even get done! :)
  • Given how many of their 'decisions' are in the public realm along with their evidence the forums are hardly filled with people requiring assistance because the IAS are chasing people for breaching their threats. Just scaremongering to prevent their rubbish ending up in the public realm.

It's a totally unenforceable contract anyway - the appellant doesn't get the chance to agree with it. But lets face it, nothing else the IAS does is legally sound anyway, it's just an attempt to get the appellant to pay up quietly.
  • I have emailed IAS today asking for them to provide the name and firm of the solicitor who acted as adjudicator in my appeal in order for me to complain to the Solicitors Regulation Authority about their professional conduct and lack of competence.

Has anyone else tried this approach and did they get the information asked for?

We already know (assume) the firm of solicitors is Gladstones. ;)

The IAS won't bother to reply at all or they might dismiss the complaint in about two months time. Don't hold your breath.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They'll tell you that for security/legal reasons they can't name the solicitor or their company. But the "Solicitor" is from Gladstones.

Of course, when they refuse, you can add that to your SRA complaint.
