Hello, thanks in advance for any replys ect,
having overstayed by ten minutes in a private car park yesterday (run by A S Parking based in newquay cornwall) we have had a pnc stuck to the windscreen demanding £100 or £60 if payed in 14 days.
I have read the newbie forum ect and just have a couple of questions if anybody could kindly awnser....
1.) is AS parking a small fry company and should i wait for the notice to keeper to arrive in the post or appeal straight away.
2.) the signage which i have photos of states that up to one hour is 50 pence and up to 4 hours is £2.10
we payed £1 and on the pay and display ticket it says FEE PAID £1.00 but only gives us 1 hour stay as there is only a 1 hour and 4 hour option,
i am just curios if i have any leg to stand on as i have it in black and white that i have overpaid anyway, the equivilant of 2 hours, which in theory is the same as paying 50 pence then coming back an hour later and paying another 50 pence for an extra hour?
thanks again,
Dan

You have both legs to firmly stand up to this bunch, run by a bloke called Kevin who hates it when we help people beat his little game at POPLA.I am just curios if i have any leg to stand on
You need a strong POPLA appeal for AS Parking - read this thread:
https://forums.moneysavingexpert.com/discussion/5008301
A well-worded POPLA appeal a bit like a 'PPS' example (see the newbies thread 'How to win at POPLA') should do the trick in the end. But double check here at the time before POPLA.
I would wait. Their NTK isn't likely to be compliant but they do send something and that will be your cue to send the template from the newbies thread. Kev will hate it!Is AS parking a small fry company and should i wait for the notice to keeper to arrive in the post or appeal straight away.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Good luck getting a POPLA code out of him, he seems to have shyed away from issuing them again for some reason
If he doesn't issue you one then complain to the BPA. He will also ask you to send the original ticket as evidence, don't do it. 0 -
He will also demand that you identify the driver. Don't.Je suis Charlie.0

Thanks, ill update when the NTK comes through,
in the mean time ill look at all the other info here and learn the process,
if it went to popla is my issue about paying the £1 fee and only getting 50p worth of time a legitimate argument, i know most parking meters dont give change but im thinking i could argue there is not a loss made as i actually paid double?0 -
it all comes under the NOT A GPEOL argument / appeal
but popla says on their website they only look at legal arguments and not mitigation ,
I wouldnt try it as a single point appeal unless you really wish to know the answer to your question and are prepared to "risk it"0 -
Nope - it's not a winning POPLA point at all, it's mitigating circumstances. And you would not be wanting to discuss 'what happened' nor give away who was driving - so I wouldn't even mention it.if it went to popla is my issue about paying the £1 fee and only getting 50p worth of time a legitimate argument, i know most parking meters dont give change but im thinking i could argue there is not a loss made as THE DRIVER actually paid double?PRIVATE 'PCN'? Just an update, its been well over 3 weeks now and we havnt heard a thing, no NTK no nothing......the car is a hire purchase vehicle but all registered in the keepers name, should i still be expecting a letter?0
-
a PPC has 35 days to respond, and 3 weeks = 21 days , do the math , and wait , wait , wait0
-
sorry i thought the NTK was supposed to arrive with in 2 weeks? all we have had is a windscreen sticker and thats it0
