AS Parking - Perranporth

Options
Hello

We parked in a car park today but one of the ticket machines was tapped off and the other was out of order. Stupidly we parked anyway and there was no other parking meters to pay at.
Two hours later we returned to see someone putting tickets on all the cars. I told the guy the machine wasn't working but his reply was 'yes it is'. He wasn't very helpful and I guess after all he cars he was ticketing, at £100 a pop, he was quids in!

So what do I do? Do I call the company and explain about the machines? We didn't take a photo but I'm sure there will be lots of other people backing up the story. Or do we ignore it?

The ticket was issued by AS Parking Cornwall.

Thanks for your help.

Of course you don't PHONE them - you are making the mistake of thinking they are from a legit industry (they are not)! You do appeal though but ONLY when the first letter arrives. Your query is already covered in the sticky thread 'Private parking ticket, old or new? NEWBIES please read these FAQs first!'

    :)
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • AND - be careful to refer to the driver in the third person and appeal as Registered Keeper. AS Parking tickets and their Formal Demand (Notice to Keeper) letter both try to get you to name the driver - which you do NOT have to do.

If you appeal via email, their auto-reply starts out by saying

"It is a requirement for the drivers name and postal address to be included in your correspondance in order for us to process you appeal. If you have failed to include this information; please amend and resubmit your appeal."

This, combined with the wording on the ticket, should be complained about to BPA and DVLA.

fyi - so far, AS Parking have only issued one POPLA code - and that was after a complaint to both the landowners and the BPA.

I'm not sure if they've stopped sending the auto-replies now - but they are certainly sending snotty emails about "template appeals" copied from mse and pepipoo!

    @Shellsam

To clarify what dementedfeline is saying, AS make the requirement that you supply the driver's details when submitting an appeal online. You are absolutely under no such obligation to provide those details - regardless of what AS may assert. This requirement seeks to override the rights enshrined in the Protection of Freedoms Act and mirrors what the BPA's alternative (the IPC's appeals process) tried to do and which they have now been directed to withdraw by DVLA. We would always recommend that you refuse to provide these details.

Template or otherwise an appeal is an appeal and one suspects that AS's complaints are rather more to do with the fact that these appeals win than the fact that they are templated.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

I'm just wondering where you obtain this information from (i.e. the number of POPLA codes an operator has issued)?
New members, please refer to "sticky" threads that are alwasys "stuck" at the top of this forum

    for the record:

their auto-reply: (complete with spelling and grammar mistakes)

Thank you for contacting A S Parking.
PLEASE READ ALL THE FOLLOWING IMPORTANT INFORMATION

It is a requirement for the drivers name and postal address to be included in your correspondance in order for us to process you appeal. If you have failed to include this information; please amend and resubmit your appeal. We endeavour to respond to all VALID appeals within 35 days. All evidence will be reviewed, which may include (but not limited to) time stamped photographic images of the vehicle. As per the Parking Charge Notice, the formal appeals process is to give the motorist the opportunity to challenge the notice if he/she feels that the notice was issued incorrectly.

If your email complies with the above paragraph, the charge will be placed on hold pending the outcome of our investigation. We endeavour to respond to all VALID appeals within 35 days. Please note, the following are NOT considered to be valid grounds for appeal and are beyond the scope of the formal appeals process:
    • Explanations as to WHY the contravention occurred.
    • Requests for mitigating circumstances to be taken into account. • Disagreement with the terms & conditions of use.

Correspondence of this nature may be given our consideration in exceptional circumstances. However for the avoidance of doubt, unless a VALID appeal is submitted, failure to make payment within 14 days of the 'Date of Issue' will result in the loss of the early payment discount. There is no requirement to submit payment with an appeal, however if you do so and your appeal is successful a full refund will be provided. We give priority to valid appeals, therefore unfortunately a timely response to invalid appeals cannot be guaranteed.

and their opening line of what is either their new auto-reply or their "2nd stage frighteners"

The standard template letter which you have copied from a web forum such as pepipoo.com and money saving expert (we have seen them all) does not actual contain an appeal we can investigate.:rotfl::D
