    sorry i thought the NTK was supposed to arrive with in 2 weeks? all we have had is a windscreen sticker and thats it

    nope, in that case its 29 to 56 days after the windscreen sticker, providing you dont contact them

    then you appeal using the template letter, within 28 days of the NTK, then they have 35 days to respond

    you really need to get up to speed on this
  • Redx's advice to wait, wait and wait is correct. For the NTK to have any chance of complying with the Protection of Freedoms Act 2012, it will have to be delivered between 29 and 56 days after the PCN was issued to the driver. Of course, there are plenty of other ways for Kev at AS Parking to muck up his NTK.

    Out of interest, AS Parking operate a few car parks covered under byelaws (e.g. Padstow, Rock, Wadebridge, Port Isaac); at these sites Kev has no right to invoke Keeper liability under POFA anyway. It could be to your advantage if this particular contravention took place on one of these "byelaw" car parks.

    The answer to your question was there. The keeper is not liable in certain places and it seems like your car park was one of them . So you have a nice get out of free jail pass when the non complaint NTK arrives!

    the 14 days is when no windscreen ticket is issued

    Where a Private Parking Company (PPC) doesn’t know the identity of the driver of a vehicle, the Protection of Freedoms Act 2012 (POFA 2012) gives it the right to pursue the Registered Keeper for an unpaid parking charge incurred on private land.

    However, land that is subject to statutory control (for example, under railway or harbour byelaws) is not relevant for the purpose of POFA 2012 meaning that the PPC may only pursue the driver for the charge. The PPC is stuffed if doesn’t know who the driver is.

    I know that AS Parking operates the Commissioners’ Quay Car Park in Wadebridge (near the Raj Bar and Restaurant) on behalf of Padstow Harbour Commissioners. If this is the car park where the ticket was issued, there is a decent chance that it could be covered by the Harbour Commissioners’ byelaws, although a bit more homework would be needed to verify this.
