Well I've received my unsuccessful appeal letter. They have kindly included some waffle on the court hearing Parking Eye v Barry Beavis and Martin Wardley, telling me how unsuccessful I will be regarding the PEOL approach.
Any thoughts or do I just go with the template POPLA letter?0 -
do as requested earlier and show redacted versions of the NTK (both sides) , maybe by using tinypic and weblinks
then look at post #3 of the NEWBIES thread and find a suitable appeal and copy and paste into notepad, then set about altering it to suit0 -
I haven't as yet managed to relocate my original ticket from my windscreen, it has been put "safe"!0

The windscreen ticket is the NTD. It's the letter through the post you got to the registered keeper I think they want to see. Good to see that PE are continuing to lie in the NTKs. But they, they are liars in chief, so no surprise there. Where, for example, in POFA does it say that the driver is required to pay a parking charge? And where does it claim that, should a person named as the driver deny the fact, that liability falls back to the keeper.
PE really are a complete joke in terms of having a legitimate business. Shame, then, that they employ utterly amoral people who are happy to take their blood money (i.e. salary) in the pursuit of launching unwarranted legal cases. Yes, I am talking about you, Ms Ledson*.
[* Was listening to a radio program where they were talking to Eva Joly, who is a French lawyer known for doggedly rooting out political corruption. She accused many lawyers of acting against the principle of acting morally where large multinational corporations were paying them large sums to effectively take the amoral line. While Capita may not fit into that category of company, PE and their legal department certainly fit this accusation.]0 -

As well as adapting a PE example, you should look at windscreen ticket examples from the 'How to win at POPLA' link in post #3 of the Newbies sticky thread. Our usual PE versions are written for ANPR camera situations where a car has overstayed, so you may need to grab some more appropriate words from a recently written windscreen ticket case such as VCS or PPS (both recently worded). You can't use an ANPR paragraph but the usual strong no 'GPEOL' paragraph is a must, including the Beavis case rebuttal you will have seen in PE examples already. And you'll need the bit that points out there was no initial loss so there cannot be a consequential loss, and a paragraph about dodgy signs/lack of clear yellow lines or hashed markings to warn drivers not to park there, in a perfectly ordinary looking place.
