    I have made my feelings about PE known to them both, and have informed Bury Council about the lack of planning permission for the camera systems.

    Do get a letter into the Bury Times as well - they've stopped printing any of mine.

    You do need to start a new thread of your own, as we work on the basis of 'one case, one thread' so advice doesn't become confused and/or we have a complete free for all with any number of random cases being tagged on.

    But first of all you do need to read thoroughly the NEWBIES FAQS sticky at the top of the forum index (one page back from here) which will give all of the initial information you need. It was written by Coupon-mad, one of the country's most knowledgeable people in dealing with private parking tickets. You won't find anything more comprehensive than this anywhere online.

    The sticky is detailed and you might need a couple of 'passes' to digest it, so bite sized chunks with a cup of tea over a couple days might be the best approach. You do need to make the effort to do some research via the sticky before asking for further help from regulars - we are so busy each day it's impossible to type and constantly repeat basic information - hence the sticky with all that stuff covered. But do come back after reading it if anything isn't clear to you.

    BUT - via a new thread of your own please.

    As ever, this is covered in the sticky thread at the top of this parking forum - which is why I wrote it. Sadly, last year it got silly as we could not keep up with all the ''help I have got a private parking ticket, what do I do?'' threads so I wrote a sticky thread BEGGING newbies to 'read these FAQS first'.

    I challenge this 'PCN' as keeper of the car, on the following grounds:


    a) The sum does not represent a genuine pre-estimate of loss. It is a disguised penalty and not commercially justified


    b) As keeper I believe that the signs were not seen, the wording is ambiguous and the predominant purpose of your business model is intended to be a deterrent


    c) There is no evidence that you have any proprietary interest in the land


    d) Your 'Notice' fails to comply with the POFA 2012 and also breaches the Consumer Contracts (Information, Cancellation and Additional Payments) Regs 2013


    e) There was no consideration nor acceptance flowing from both parties and any contract with myself, or the driver, is denied


    f) Your ANPR is not maintained or in correct working order. Furthermore the system is not operated in a reasonable, consistent and transparent manner


    The purpose of this communication is threefold:


    1. Formal challenge
    There will be no admissions as to who was driving and no assumptions can be drawn in the absence of evidence. As such, you must either rely on the POFA 2012 or prove beyond any doubt who was driving - or cancel the charge


    2. ''Drop hands'' offer
    I calculate that we have both incurred some nominal costs - under £15 – so this is a formal “drop hands” offer. I remind you of the duty to mitigate any loss, so withdraw the charge within 35 days without further expense and I will not pursue you for my costs



    3. Notice of cancellation of contract
    I hereby give notice of withdrawal from this alleged contract which was never properly offered or explained by you. The charge is not acknowledged, is not due and no 'service contract' from you was ever expressly requested by the driver or by me. Neither the driver nor myself gave 'prior express consent' or any consent at all for any contract to exist. This 'contract' is hereby cancelled and any obligations now end


    This constitutes the entirety of my challenge and nothing further will be added. You must now, within 35 days, EITHER (i) accept my challenge and notify me that the charge is cancelled, OR (ii) reject my challenge, send me a PoPLA code, and suspend any collection activity pending my PoPLA appeal


    This is submitted online so I have kept a copy and this communication is clearly received by you unless proved otherwise. I look forward to your reply within 35 days and urge you to accept the drop hands offer and accept that I have cancelled any 'contract' because this resolves the dispute without cost


  • well good news got 2 fines a week apart and appealed to both! First my own letter with some reciepts copied 2nd one used the TEMPLATE FROM HERE both cleared!!!! so don;t just pay up .. Good luck

    Dear Sir / Madam,
    We refer to the Parking Charge incurred on xx November 2014 at xx;xx:xx, at Woodfields Retail Park, Bury car park.
    We can confirm that this Charge has been cancelled and there is no outstanding payment due on this account.

    I received a PE fine about a month ago saying that I had parked on Woodfields Bury for 9 hours on a certain day. I had nipped to collect a parcel from Next in my half hour lunch, and then returned later that evening to do my shopping at Tesco. They had one photograph of me arriving and one photograph of me leaving. Obviously I appeal, using the email appeal page on their website. I was told with a automated response that it may take up to 14 days for them to get back to me. That 14 days is up today and I have heard nothing.
    Please could anyone advise on what I should do? Where does this leave me, apart from probably getting nowhere!

    under BPA guidelines they have 35 days to accept or reject your appeal, so expect a reply within 2 to 4 weeks from now

    if you need further help, start a new thread using the blue NEW THREAD button and copy and paste this info plus any new info into the new thread post
