    Just a bit of feedback for you for Woodfields:

    Received 3 "fines" in one week on this car park from Parking Eye
    Followed newbies advice on MSE

    Appealed online using the initial template appeal letter (taking screenshots for evidence)
    No receipts submitted either

    Charges were cancelled for all 3 on 1st appeal.
    A friend also won her appeal at this stage.

    Parking Eye have certainly been noticed to fold like UKPC do, when they see the first forum appeal. If only EVERY victim used it, that would be amusing!

  • Great news on the appeals. I've just informed the planning department that Planning Permission does not exist for the ANPR for this car park or another one at Moorgate (yes, we got shot of UKPC, only to be replaced with PE a few months later). Council are investigating.
  • Some friends have been caught here at Woodfields, received PCN from PE today. I've sent them a copy of the initial template appeal letter, will report back on the outcome.

    This is a massive car park, where people regularly park and walk to other shops - I'd imagine it's a big earner for PE if most people pay up.

    I followed the advice on the 'Newbies' post and had my charge cancelled. I only had to send one letter which I have copied below:

    Dear Sir

    RE: PNC No ****************

    I refer to the above notice which I appeal against, as a keeper of the car, on the following grounds:
    a) The sum sought does not represent a genuine pre-estimate of yours or your principle’s loss.
    b) The signage on the site is deficient and fails to comply with the British Parking Association’s Code of Practice, Annex B.
    c) In the absence of any evidence it is my case that you lack any or sufficient proprietary interest in the land.
    d) Your notice was deficient and fails to comply with Schedule 4, Protection of Freedoms Act.
    Please uphold this appeal or send a rejection letter so I can escalate this matter to the independent service offered by your trade body.

  • As an update to my previous post, my friends have now received a reply to the initial appeal letter to PE which I helped them to draft, and had the charge cancelled:

    Reference: Parking Charge Notice - xxxxxxxxxxxxx

    Dear Sir / Madam,

    We refer to the Parking Charge incurred on xx October 2014 at xx-xx-xx, at Woodfields Retail Park, Bury car park.

    We can confirm that this Charge has been cancelled and there is no outstanding payment due on this account.

    I've finally got around to taking a picture of one of their signs which detail their silly terms:

    Doesn't look terribly clear to me. Can anyone else read the small print? If you park in the car park, then drive away and return to fill up with fuel, you technically haven't "parked" the second time, so does their wording reflect that?
  • If you look to the left of that sign you'll see a few TESCO signs on the filling station boundary wall that refer to 'vehicles will be clamped' and an '£80 fine' issued. I kid you not.
