I can understand the SCC claim route, might be an idea to set up a new thread, I'm hanging right here though till we get OFCOM to do what they're meant to and I get access to my free ADR0
-
So I got this:
What is now the next step?
If I'm right and you haven't submitted a claim with CISAS previously you will need to write an email to CISAS asking how you can have a claim rejected when you haven't had any previous claims in the CISAS process.this does undermine the hole CISAS process somehow.0 -
It has now been 6 days since my initial email to EE, with a follow up 4 days ago, and still no response.
It was the first email to EE that I used, and it was sent to: " executive.office@ee.co.uk,
Olaf.Swantee@ee.co.uk"
just to check I didn't get those wrong?
What should I do now, surely I should have had some sort of confirmation of receipt, or thanks we are looking into it and will get a reply blah blah..?
Should I try and force it through with a phone call, suggestions please?
When sending the email as suggested by @Mikmoken also add:
"I would also like you to confirm how ignoring my emails to date compiles with Ofcom GC14 on complaints handling. I understand that Ofcom are currently conducting an investigation into EEs complaints procedure and I have copied this email to Ofcom so they can add it to their evidence file"0 -

Already done, maybe add another follow up?0 -

I'm happy to go along with whatever you recommend. At present, I'm the only one who is in the process of starting a SCC case, but certainly can move to a new thread if necessary!
RC - Is my letter before action alright? I just need to work out the monetary amounts (shall look at the file Mikmonken provided) but aside from that, I'm about ready to send it0 -

Never straightforward with me. Working out the amount owed is tricky because obviously the price rise took effect halfway through. I think I've worked it out though. I've put down to refund back to 8th May (1 month after those of us on the price rise claim sent the initial Termination notice email to EE).
It works out about £186 thus far, rising by £36.61 + £0.90 each month T-Mobile/EE fails to act. Obviously, this has a cut off point because my contract expires on 21st November. Safe to say I'll not be renewing if I've not been given the termination by that point!
I'd just add that the XLS file was useful for working out the sums, but I've used the total outgoings from my account as this is larger than the XLS file was showing! (130 days or something vs 5 months actual payments taken)0 -

I think in the LBA you should list the laws you will be relying on "including but not limited to":- UTCCRs
- GC
- USD20/22
- Unfair Trading Regulations

How would you add it in? Something like the following or does it need more description? I've absolutely no experience with court cases of any description! My case will rely on the provisions afforded to me by law, including but not limited to:
1) UTCCRs
2) GC
3) USD20/22
4) Unfair Trading Regulations
I was also planning to just email rather than post a letter - I'm not likely to get to a post office this week as on night shifts all week!0
