    RC,

Can I have your opinion please.

I had 2 CISAS cases against EE fail (all using your templates, T&C's and then Price rise). In both cases CISAS adjudicators acted more like EE defence, not even acknowledging the basis of both claims.

My EE contract is running out tomorrow.

Would you suggest trying the LBE and small claims route for a full refund (from T&C's change)?

Remember I have a real loathing of Ofcom and EE as both have been abusing the consumer for too long - so I may be a little biased!
I would take it the SCC, but that is because I would be wanting to prove a point, more than for financial reasons. The choice is yours.

    for Ofcom

Yes please - or a version of it.
  • Sent the same response to CISAS as Barrowvian - lets see what they say, theyll probably ignore it!
  • Yes please - or a version of it.

Can we still send it if we missed a step or two and hadnt sent the last email and therefore didnt get an email from Ofcom?
  • Have you still not been told by CISAS you claim hasn't been accepted?
  • This could really play out well in terms of CISAS ballsing up process of you still haven't been informed.

If you have preface your email to CISAS with the request for info and then follow on with RCs email

Sorry - thought I had responded to this - for you it is time for the SCC.

Send EE a "Letter Before Action" (can be an email as long as it is clearly headed "Letter Before Action". Outline the basis of you claim (does not need to be in great detail)
    1. Previous prices rise are unenforceable as they are unfair under the UTCCRs, and
    2. T&Cs change was of Material Detriment
And state the remedy you seek
    1. Refund o al previous price rises and
    2. Penalty Free termination from date X wit a refund of all sums taken from your account from that date and a PAC code.
Give them a date (at least 7 days from the date of you email) on which you will begin proceedings through the Small Claims Track of the County Court.

Thanks for the reply - don't worry, with the amount of claims and threads that are on-going, the odd post will slip by!

I know you've put a bit of guidance, but I'm still not sure what to put in the email :-/

Yeah i have - i presumed RCs email (the longer one) was to Ofcom copying everyone else in? Ive already emailed CISAS asking for copies of all comms between them and Ofcom/EE etc and questioned their "independent" nature
