    Another success here.

    Claim succeeds, backdated penalty free cancellation to 10th July and PAC and unlock code. The adjudicator was Keith Richards, in case anyone wants to know.

    Not sure why it's only backdated to then, I first contacted them back in February, but I did mess up my emails to them a bit, and also my emails to CISAS. I'm just glad to get out of the contract since I broke the phone :doh:

    Anyhow, thanks very much to RC for the advice and for providing the templates. I assume your favourite charity is still Haven House Children's Hospice? It'll be my pleasure to make a donation to this extremely deserving cause, and thanks again for all your help :)

    I received my CISAS decision 3rd July and received my full refund from T Mob yesterday. £260 towards a sim free handset for my new sim only contract :T:T

    A copy of a PM sent to MSE - this is about the third such PM I have sent since we started the new campaign - and still no response :(




    Dear MSE:


    Two big developments this week:
    1 - CISAS have accepted the first case submitted in the new campaign - EE now have until 3rd September to provide a defence.
    This was the first "hurdle" we needed to get over as potentially CISAS could have just said that the case was out of time and dismissed it - so it really is game on now.


    2 - One of the price rise cases which was "out of time" (notice to terminate was sent after 30 days) has been WON! - See post #1538 and #1539

    This is of major importance as the adjudicator is effectively saying that EE can not hide behind a 30 day time limit IF they have not given the correct notice.


    As 97% of T&C case were won by the consumer, the only thing preventing 97% of people wining in the new campaign is the time limit, and this seems to show that there is a fair chance the time limit will NOT be an issue for us.

  • My case has also been accepted by CISAS. EE have until the 4/9/14 to submit their defence. I hope I get a lazy-!!! person who can't be bothered reading that 20+ page document haha
  • Accepted here too - fingers crossed for us all!
  • I sent off the new complaint letter to EE and with no fuss received a letter referring me to CISAS. I'm going through the case to submit, using RC's template but would appreciate some guidance on this bit:

    "Due to the above I request that my contract is terminated backdated to 30 days after my initial cancellation request (with any sums taken from my account in connection with services from that date being refunded)."

    What exactly was my initial cancellation request? The letter I recently sent to EE, or am I requesting cancellation backdated to the time of the contract change?

    Your initial cancellartion request is the date that you sent the first email in RC template for this forum.

    Hope that makes sense

    Just had my letter from CISAS accepting the new claim with EE given till 03/09/14 to respond. Here's hoping for a swift response & all requests met by EE!!!!

    Thanks again to RC on all the hard work put into this second claim albeit number 3/4 for him :beer:
