I love the fact that the parking notice is immediately above the clamping notice. You do know clamping is illegal for private parking companies do t you. That picture is priceless and should win at POPLA alone with nothing else! (But don't try that)
Yes wait for NTK and use appeal in newbie thread. If it gets rejected the come back for POPLA appeal help. You have a gold dust of a picture there with the daft conditions and the clamping sign together!

Hi guys I have received a letter now entitled "formal demand" from UK Car Park Management (CPM) asking me to pay the now £100.00 charge.
I have read the newbie sticky and from what I understand, I am now supposed to copy and paste the template appeal onto word, print it off and post it to the appeals address given at the back of the letter? Is this correct and if so, can I expect them to reply back saying the charge is cancelled? I also wanted to know what I should do with those photographs I have taken and if they can help me at all.

So you have now received the NTK.
now is the time to send off the appeal as per post 1 of newbie thread.
At this stage you don't need to do anything else.
Within 5 weeks you should hear back with either a cancellation of PCN, or more likely a rejection of appeal.
At that point you will put together your POPLA appeal, which will include the photos you have as evidence. You will need to look at examples from post 3 of the newbie thread . Do this whole you are awaiting the probable rejection as this gives you time to get your head around what is said next.

Can you show us the letter please? What differences or omissions have you found when comparing it to paragraph 8 of the POFA (don't panic it's EASY to read, in bullet points and the Act is linked in the Newbies thread). Please take time to compare the letter as you will feel more empowered, I suspect, if you aren't having to be spoon-fed what's wrong with it. Simply a game of 'spot the difference' needed. You will also understand your POPLA appeal much better at the second stage if you have spotted for yourself why that letter might not establish 'keeper liability'.PRIVATE 'PCN'? So have you sent your POPLA appeal yet? Hope you haven't decided to ignore or pay the silly thing! You are about to win at POPLA if you send an appeal based on our examples (in the Newbies thread 'How to win at POPLA' in post #3 of that sticky) and include the fact the NTK isn't compliant with Schedule 4 so there's no keeper liability (that part of your appeal must show the omissions which is easy as I've shown them in the link!).PRIVATE 'PCN'? I've just received a letter from CPM saying they've rejected my appeal. It's been such a long time since this situation occured I'm honestly lost as to what to do right now. I was really reassured reading your posts on this thread but I am honestly quite nervous and upset again. am I right in thinking I can appeal to popla and everything will be fine? Even so, I don't have a clue what and how to do it. Any help would be truly appreciated. Thank you!0 -
