There are four tickets, right? And four NtK's? So please check the timings on each NtK, in line with the information above.

I'm starting to get myself confused now. There were 2 tickets in January where the NtKs were both late. There were Keeper Liabilities letters sent for these 2 which I received both on 1st May.

Then 1 ticket 3rd February with a NtK on 25th April (late). I received a Keeper Liability notice for this on 9th June.

Then 1 ticket on 4th February with a NtK on 25th April (late). I received a Keeper Liability notice for this on 9th June.

On top of that I had 2 more tickets in April and May, both of which I haven't heard from yet which are way overdue.

Then 1 final ticket in June which is still in the first 28 day period.

As I suspected they are systematically issuing the NtK's late. Someone has read POFA 2012 Schedule 4 and has misunderstood it!

So, what I would do would be for the registered keeper to email the BPA to complain that the Uni of York, who are an AOS member in their own right, have sent letters telling her she's liable for tickets and citing the POFA 2012 when in fact the NTK letters were too late (some way beyond the 56 day deadline for keeper liability). State clearly that she knows that for an AOS member to pretend keeper liability applies when it does not, is a serious breach of the BPA Code of Practice.

She'll need to attach all the letters and if more than one PCN is involved then set out a clear timeline of the date of each NTK and the alleged parking event mentioned in it. Only mention the ones that were late - were they both late? Send it all, attachments etc., by email from HER (new email addy set up in her name) to:

    steve.c@britishparking.co.uk

Everything should come from the keeper, no mention of who was driving nor the PCNs on the windscreen. No need for her to try to explain why she didn't 'appeal' since she doesn't have to, it's not a Council PCN or anything and in any case the deadlines for keeper liability having been missed, renders the letters a nullity.

She doesn't have to even contact the Uni just yet - let the BPA investigate it with them. It's a serious breach.

You should consider putting up info in the Student Union noticeboard, student magazine and around and about, spread the word about this forum, not to ignore PCNs but to appeal them as registered keeper when the first letters arrives (not sooner) and then to use words like the charge is 'not a genuine pre-estimate of loss'. At least tell your friends this so they know!

Wow, I didn't realise this was such a serious breach! This is better news than expected... My sister and I will write up a letter to send it to BPA. What could happen to the universities parking scheme in the worst case scenario?

I have just gotten in touch with the media so this news should spread hopefully. I know for certain a lot of my friends at uni have had tickets in the past and are worried about them. I'll let them know not to pay anything.

And then received Keeper Liability Notices 5-6 weeks after the NtK!:rotfl:

So don't do anything about that one if that's only a windscreen ticket. The keeper would not be aware of the latest THREE.

The others, all 4 of them, attach a copy of the NTK and misleading letters received by the keeper, to an email complaint to the BPA.

Give the dates shown as above but don't say stuff like 'ticket on 3rd Feb' as the keeper would NOT know about any 'ticket'. The keeper (remember the complaint and the contact ALL comes only from the keeper so set up an email account in their name if need be) should say:

'the date of NTK was xx/xx/14 and presumed received two working days later - but date of parking event was given as xx/xx/14 which was more than 56 days before. Same goes for all of these four Notices so please investigate why your AOS member is trying to hold me liable when I am merely the keeper, was not driving on any occasion and they have missed the deadline for keeper liability in all four instances I am aware of. This is getting beyond a joke and I am not liable in law and a University should be well aware of that fact.'

The keeper should NOT IMHO mention the April/May ones nor the June new one.

And you should not park like that again as if they lie in wait and demand your student card you will be a target and on a sticky wicket. Think yourself lucky the driver has stayed anonymous/unproven in all these cases.

A slap on the wrist from the BPA or sanction points that get wiped clean every year. Sorry!

Be careful with the media - you are currently ANONYMOUS as driver so don't change that. The keeper isn't liable but the driver COULD BE. The POFA 2012 isn't needed if they aim these at you as driver instead so the last thing you should do is show yourself to be that driver. They could pursue you.

I am worried you are getting a bit carried away - we are not condoning this parking by students! WE ARE MERELY SAYING THE KEEPER ISN'T LIABLE AND ALL THE TIME THE DRIVER IS ANONYMOUS IT'S SAFE AS THE KEEPER CANNOT BE HELD LIABLE. Doesn't make the parking OK, doesn't mean they won't try to work out who the driver was likely to have been. They could even call you in to speak to you about it so don't raise your head above the parapet.

    This is the keeper's complaint

Sure thing I will get all this sorted. Thank you so much!

I did actually bump into the parking wardens. It was a few days after one of my tickets and they saw me get out of my car. They are an external company hired by the university to do what they do. The guy said "I've put tickets on your car a few times now, you have to pay those you know or we'll take you to court" I said "I am paying for them" and he just agreed and said he had no way of finding out if I was paying or not.

Be careful or this will all end in tears. Stop parking there and don't get media attention.
