Unfortunately the operator has no record of receiving your appeal. As no appeal was received, the charge continued as per the process.
Do you have proof it was sent and received?

I read this thread with great interest as its virtually the same situation I've found myself in. My POPLA appeal is pending...

Quick update....email response received from BPA:

Thank you for your patience whilst I looked in to your complaint with the operator.

Unfortunately the operator has no record of receiving your appeal. As no appeal was received, the charge continued as per the process.

I provided a copy of the appeal you sent in and this has been passed to the operator to consider. The charge has been frozen and the operator will review the appeal and respond either accepting or rejecting the appeal. If the appeal is rejected, POPLA details will be provided to you to allow you to appeal to the independent appeals service.

If you do not receive the appeal response, please do not hesitate in contacting me further.

In view of the above I have closed the investigation.

    Kind regards

Nothing more than I expected tbh

by the same standpoint, you could deny any paperwork had arrived, yet they would say their NTK etc still stands even if they didnt have proof of actually sending it , nor proof of it arriving

its heads they win, tails you lose in these circumstances

At the time, the letter from TNC states to appeal to them, which I did, via their website with a note saying see attached, and attached a 2 page pdf based on the newbies template. I appealed 2 within days of each other, so apparently they don't receive any appeals through their own website.

Incidentally, the latest letter I have from TNC, dated outside of the 56 days from PCN issue, states that they DO NOT handle appeals, and you should appeal to the PPC that issued the "ticket", which I have done this time.....now waiting their response.

For anyone following this thread, I've repeatedly asked our managing agents, Warwick Estates, for copies of all contracts relating to the parking. So far all I've managed to get is a template of such a contract, but not any ACTUAL contract. Bottom line, in this case, as W.E and UCS Parking are connected (basically sister companies), I can't see a contract even being in place between them, let alone any contract in place with the land owner giving permission for them to even operate such a scheme on their land. It's got to the stage where I actually WANT them to argue it all the way to court!

Yes exactly...and complaining to the BPA is complete waste of time, as they'll never challenge one of their members or tell them to cancel it as they're obviously talking shiiite lol

    Update... I WIN :D

Following the latest letters from TNC, which are worded differently and now advise that they do not handle appeals, and appeals should go UCS Parking, who issued the PCN, I've sent 4 appeals to UCS this morning and got an almost immediate email back

    "Dear Mr Patch

    Thank you for your emails.

We are assuming you will be sending a letter for each charge. Please be advised there is no requirement to do this as the charges have been cancelled following instruction from our client.

    Kind regards

    Administration Team"

    Finally!

So.....following the above, around 2 weeks after my PCN's were cancelled by UCS Parking, the signs in the car park vanished....and last week I received a letter from Warwick Estates (went to all residents) informing us that the "parking enforcement" is changing to UK Parking Solutions. We will have new permits issued to us and "if you do not want your permit delivered to the flat, you must let me know by Monday 6th July 2015".

I've waited until now to see if UKPS send anything to me with their T&C's, but they haven't. So I'm just writing to WE to tell them I don't want any permit delivered to my flat and that I will not display it as per previously advised.

Before I hit send, any other input? Always gratefully received :)

T R Luckins Limited t/as UK Parking Solutions. A BPA member, so the POPLA route is available to you - with a cost to them of £27 per ticket!

Nice! They shouldn't bother you for too long!
