    I sent the email to WE, including Coupon-mad's text from the previous page, and I just got a reply from WE

    "As I am sure you are aware the parking bays are not demised to the flat, therefore you do not own the parking bay but they belong to [apartment block] RTM Co and the space is allocated for your use. It would be normal practise as the company feel there is a requirement for parking enforcement to be put in place to refute your request. However I can see that this will not help the situation and will therefore agree to remove your allocated parking bay only from the parking enforcement on the following conditions

    • That you or your visitors only park in your one allocated parking bay
    • That if you or your visitors are found to use any other bay then you are like anyone else in the car park are open to receiving a parking ticket, such tickets will not be cancelled
    • Is another resident is found to use your parking bay without your consent then the parking enforcement company cannot get involved, and whilst your bay is being used by someone else you will need to find alternative parking, outside of [apartment block]
    • There is no reduction in your service charges for removing you from the system
    • There are no white lists in place now, as long as you only use your one parking bay then you will be ok with any vehicle that is parked

    If at any time we find that this system is not working then [apartment block] have the authority again to request that you display a permit."

    I don't think I'll agree to more terms they are trying to impose on me somehow.

    if popla is an option why not play the popla game? you could also introduce your entire neighbourhood to it as well.

    My letter to you was not a request nor an invitation to negotiate.
    It stated my position, consistent with the terms of my leasehold. I reject all the terms set out in your reply and my position remains unaltered.

    Already been down this route with the previous PPC the management engaged with. Had all 22 "tickets" over a 12 month period cancelled. Trying to avoid the same BS again, but it's difficult when the people you're dealing with think they have the right to change your lease terms...

    You got 22 tickets cancelled at PoPLA?!?!?! Well done that man, that cost them about £600 in PoPLA fees! No wonder UCS has pulled out, must've been mad to keep ticketing you after the first half-a-dozen!

    If I were you I would be inclined to write a cheeky letter to T R Luckins Limited t/as UK Parking Solutions, attaching copies of all 22 PoPLA adjudications, and suggesting that they may wish to refrain from ticketing your car lest they too wish to pay hundreds of pounds to PoPLA!

    No, they (UCS) cancelled all of them before even bothering to give me POPLA codes. I'd appealed to them and they failed to reply in any way, then they started hassling me again, so I put 2 complaints in with BPA and with DVLA. BPA (Steve I think it was) got back to me and said UCS didn't receive my appeals (BS of course as I sent them via their own website portal), so I sent them again.....and again, nothing. Then they sent me another letter, and I emailed them and they told me not to bother sending the same letter for every PCN, as they'd all been cancelled.

    Otherwise, your suggestion would be spot on again baz! haha

    They are in fact totally capitulating, what they might do, if you park in someone else's space is of no consequence at the present time, nor is it a matter of concern to you if one of your tradesman/visitors, parks in a neighbour's place. They must fight their own battles.

    Of course your parking space is not demised to you, they rarely are in blocks of flats, but you have purchased the use of a space, and are entitled to "quiet enjoyment" of that space, if they, or their contractors, attempt to interfere with your leasehold rights they must be prepared to defend their actions in front of a Tribunal/judge.

    Also, I suggest you do as Mr B advises, and rub their noses in it.
    You never know how far you can go until you go too far.

    Twenty Two tickets? if you want to fight back somehow then see if you can beat that.
    Tell the management company that you do not agree to any modified terms to display a permit.
    Next just collect the tickets, depending on how often the car park is patrolled you could/should be able to get a ticket a day.
    Once youve got your first POPLA win it should be case of copy and paste and off to popla each day.
    After youve got a few popla wins, publicise them in your neighborhood let everyone else know and see if others can join in the POPLA game.
    If anything it will keep the parking attendant/local Norris Cole extremely busy, keep POPLA assessors in a job, and help build community spirit.
    In theory you could get at 364 tickets challenged to popla a year if you can get 5 people to play POPLA then thats 1820 tickets issued in your neighborhood keeping the ticket issue person busy and in gainful employment, keeping POPLA busy and helping your neighbourhood when it comes to a residents meeting you could also highlight the popla wins
    win win all round.

    "I am certainly not trying to negotiate with you but merely pointing out that you have the exclusive use of one parking bay, if you and your visitors only use this one parking bay then I can confirm that this will not be patrolled, however I cannot extend this to other parts of the car park as your lease only give you the right to use one bay."

    Looks like I'll be going through the appeal, POPLA, route before asking them if they want to continue this silly game yet again.
