    If you have exclusive use of that parking space, then you are also entitled to "quiet enjoyment" of that space. As far as I can determine, the same principle of UKPC vs Davey applies here.

    Update.....email response from DVLA

    Thank you for your correspondence concerning a parking charge being pursued by TNC Parking Services, in which you have stated that you have not received a POPLA (Parking On Private Land Appeals) Code following your appeal.

    To allow your complaint to be investigated appropriately, please could you provide a copies of notices and correspondence for this case, specifically could you provide a copy of your appeal and proof that it was submitted within the 28 days as prescribed by the BPA Code of Practice (Section 22.7). Proof could be a copy of the proof of posting.

    As this complaint is specifically about an alleged breach of the BPA Code of Practice the DVLA will request that the BPA investigate, take the appropriate action and report the full details to the DVLA.

    I've sent the reply, starting with

    I’m disappointed you wish to hand it over to BPA to investigate, given their statement “The BPA exists solely to support and represent its members, be they public or private sector…” (source: http://www.britishparking.co.uk/News/monday-musing-why-wouldnt-you-be-a-bpa-member ), I cannot see any reason they would actually do anything about the issue, which is an ongoing one. That is why I’ve complained directly to DVLA, who I feel should be better protecting my data from such misuse!

    Quick update, but not specific to the parking side of things this time....

    Today I came home to find the cleaning contractor has been replaced.....with a new company that is owned by the director of the RTM company and based out of WE's local office.... I'm pretty sure that's a conflict of interest!

    Quick update....email response received from BPA:

    Thank you for your patience whilst I looked in to your complaint with the operator.

    Unfortunately the operator has no record of receiving your appeal. As no appeal was received, the charge continued as per the process.

    I provided a copy of the appeal you sent in and this has been passed to the operator to consider. The charge has been frozen and the operator will review the appeal and respond either accepting or rejecting the appeal. If the appeal is rejected, POPLA details will be provided to you to allow you to appeal to the independent appeals service.

    If you do not receive the appeal response, please do not hesitate in contacting me further.

    In view of the above I have closed the investigation.

    By which they mean "the operator has destroyed all evidence of your appeal and is now pretending never to have received it. Unfortunately they now see that such dishonest and possibly unlawful behaviour has been rumbled, so they are looking at it again." You need to remember that PPS lie as easily as they breathe. Sounds like your management company is pretty similar: unethical, dishonest, corrupt.
