    Re: calculating debt - that's the hard bit as the statements I need are over 6 years old. And they won't send them - I did ask!

    CAB reply came this morning.

    It says:
    "Thank you for your letter of 30th July.

    Your credit agreement is regulated by the Consumer Credit Act. You do have a copy of the credit agreement, but this does not give the breakdown of the additional charges added by MCS. You should ask for these details from MCS.

    You may well have a case to dispute the addition of credit loan insurance which included your ex-husband, but excluded you.

    The comments from the on-line forum can all be used in an attempt to get your debt reduced, but we cannot say whether it will be successful

    Then they have enclosed some print outs telling me about CCA's. They also give the telephone number of the Ombudsman.

    Finally, if you feel we can assist in re-negotiating your debt please call into one of our offices as shown on the leaflet enclosed. (But then they forgot to enclose the leaflet!!!)

    At least you know where you stand at last. I would be tempted to go back to the CAG site and post the first para of the letter up there so other people are properly advised in future.

    Did you ask MCS for details of the additional charges?

    Can you fix up to go over and see CAB in person with your statements and work out how much of the debt was directly due to your repeated overdrafts. That is a figure that would help. if necessary take the kids and sit them in the corner with some toys or whatever.

    As I said this is not going to go away.

    What we can go for is misselling the PPI, letting you increase your debt in the absence of any discernable income in a manner that lead to repeated charges and the additional and unnecessary stress and hardship caused by their more recent handling of the account.

    Given the current situation with the charges issue, they are not going to roll over at the first letter. What we can hope for is that when it is referred to the FO, they offer a substantial reduction in the debt.

    What you are going to have to accept is that you jointly benefited from the money that you continued to draw from your bank account despite the fact that you had no income. If nothing else it paid the mortgage.

    The more awkward situation is that you obviously have equity in the house, so they may be less keen on reducing the debt, but in your current situation you cant release anything to do a full and final settlement and you could not afford the increased cost either.

    Did you get anywhere re the houssing benefit?

    No letter from either yet. I can't get through to Housing Benefit people on the phone either.

    Did have the Callcredit credit check through the post today, though, so that's the 3rd and final credit agency which has come up clear. (!) Just got to get the ex off all of them and they're done with.
