Can you write to the HB people again and ask them?If you've have not made a mistake, you've made nothing0 -
Have gone one better! I spoke to my Lone Parent Advisor lady who couldn't help directly apart from looking on the screen and agreeing no benefits had been paid. However, she said to print off another letter and she would put it in the internal post bag between the JobCentre (where she is based) and the social security place.
So I did that this morning.
No SAR yet, needless to say.
Also got my legal aid bill yesterday for the divorce which is £18,000 so that's another debt to add on!

Really very cross today.
I sent the SAR letter the other day with a £10 postal order.
Today I got a reply as follows (although I am shortening this slightly)...
"Dear Mrs X,
Thank you for your recent payment on 13th of August. Whilst this indicates your intention to repay this debt we do not appear to have a firm committment in the form of a repayment plan... fill in the tear off slip below etc etc"
Stupid idiots! It was clear as day what the £10 was for!!!!
What shall I do with MCS NOW....?

I had the same, last year, with Black Horse (LTSB). I had sent the original letter, by recorded delivery, and included the £10 p.o., which they also 'credited' to the alleged debt and did not send me the information.
I wrote back, stating,
" You have failed to reply to my letter of xx June 2006. A copy of this letter is enclosed....
Also it appears that you have credited the £10 (which I had sent you as the maximum statutory fee that you would be entitled to charge for providing me with this information) towards the amount that you demanded in your original letter, dated xx June 2006.
I have, as you will be aware, since received THREE letters from a Company calling itself Nationwide Collection Services Ltd., but which I believe to be your own internal 'Debt Collection Agency'. The last of these three letters, dated xx August 2006, threatens me with 'Immediate Legal Action' if I do not pay the Full stated amount within seven days.
I am fully entitled to ask for a full and detailed statement as one was NOT supplied with your letter dated xx June 2006, and I am, equally, fully entitled to question ANY part of the 'alleged debt' with which I am not happy.
I feel that you are acting in contravention of the OFT guidelines on Debt Collection by passing this 'alleged debt' to NCS without having provided me with the information that I required, and am legally entitled to, that would have helped me to make an informed decision over your original demand for payment.
I find the tone of those letters that I have received from NCS, to be of a threatening and intimidatory nature, again contrary to the Guidelines for Debt Collection as laid down by the Office of Fair Trading.
I will, therefore, be reporting both Black Horse Finance, and Nationwide Collection Services, to the Trading Standards Department and I inform you that I have, today, registered an official complaint, with the Information Commissioners Office as you have failed to provide me with the information that I requested within the allowable time-scale."
Obviously I have edited the original letter, but ONLY to remove personal details. NCS are the LTSB(Black Horse) internal debt collection department in the same way that MCS are the internal debt collection for HSBC - in your case.
I sent this letter to the person (a Mr John GODFREY) whose computerised signature was on every letter that I ever received from Black Horse. I also sent a copy of this letter to EVERY address that I had for Black Horse (6 in all) including a copy to the Chairman of Black Horse in Gresham Street in London.
Within 7 days I received a parcel containing full statements, transcripts of all phone calls, copies of letters, and a copy of the original cca. There were flaws in the account, and I was able to 'negate' a lot of the original claim.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
