On Saturday morning I received a Claim Form from Northampton County Court, service date 2nd July. The parking charge occured back in March 2012. I have ignored all correspondance since then but now finding it hard to follow all the threads with what I need to do considering it was before the law changed. Please help.

Ok
Starting point, Newbies thread post 5
You will need to respond and say you are putting in a defence
Recommend buying Prankster's guide.
However also recommend you rapidly putting in a complain to the Co-op CEO . Again search forum as there are lots of examples of people who get this cancelled even at this late stage.
Lots of other threads in recent days with lots of advice. Search Northampton or co-op using search this forum facility at top right of forum.
Another expert will be along to give you more detailed advice, in the meanwhile keep reading.
The fact that it is a pre-pofa12 claim means that your first and most important defence is that there is no liability to keeper and as such you can not be held liable, only the driver and as you do not know who that was, you are not liable.
But the defence has to be much more detailed than this.Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.0 -
Search this forum for 'Co-op July'. Loads of threads...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have purchased the 'parking pranksters guide' but this is specific to ParkingEye. I have tried my hardest to use it as a general guide but it is getting to complicated. I have rewritten the deference letter but I have got myself in a pickle as my charge relates back to march 2012, pre the protection of freedoms act 2012. I also can't quote or use POPLA so my agreements are different. Any advice would be welcome. I keep referring back to the section 5 to indicate to but getting confused with how things have changed.
I have sent off my acknowledgment to Northampton County Court today and understand I need to send a letter to complaint to CEO of Co-operative and get my deference ready.
Thanks0 -
Would be interesting when the judge asks why it has taken over 2 years to come to court as the PPC couldn't have missed the money that much.
Which PPC is issuing claims for old cases (probably will fold as soon as a defence is added, probably hoping for a panic settlement)?0 -
its CEL and co-op, blogged about months ago on parking pranksters website, also plenty of threads on here about it too , plus the co-op need contacting as they are helping those affected as well

We know - CEL for short. Covered dozens of times, it's always them rattling the Co-op's cage and using the Co-op's customers as pawns.
As I said, search the forum for 'coop' (no need even for a hyphen). Also put the word 'coop' (no hyphen or it won't work on pepipoo) into the bottom left search box on 'pepipoo forum' and you will find even more cases showing the complaints and advice people used to overcome this. Pepipoo have covered this umpteen times and no-one has paid:
http://forums.pepipoo.com/index.php?showforum=60 (search box bottom left, put in 'coop' and read the results)
Also read post #5 of the newbies thread here, it's why I wrote that section, all about court claims and what to do when, etc. Plus links to cases won such as the McCafferty case which you should cite in your defence if you have to go that far. A defence has to be in within 28 days of service of the papers so you have the whole of July to get the Co-op to step in.
I would just email the CEO of the Co-op - or one of the Manager's names in the threads you'll read - the angriest email you can muster. How dare they let an agent sue their customers?!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have sent off my strongly worded email today. Was quite ironic that I also received today a letter thanking me for my support as a customer and some vouchers to reward me some of their profit. Makes me so angry.
Do I now need to write a deference and send it off? All I have done to date is the acknowledge of service and the email to the CEO.
I did try to send a copy of my email across but it said that there was too much mail already in the inbox. Thanks0 -
You have 28 days to submit the defence, counting from the date of service of the court papers. Most posters spend a couple of fruitful weeks rattling the Co-op's cage (several Managers, any/all Co-op Head Office names you see on all those threads like yours) non-stop to try to avoid having to defend at all - but don't take your eye off your deadline to defend if you have to. Post #5 of the NEWBIES thread has example defences that are not all ParkingEye versions.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
