cel court papers ......need help please

Hi folks,
I recieved court papers from CEL today and they appear genuine for an alleged infringment on 22/10/12..........................so i need some help to fill in the forms correctly in order to mount a defence.
Am obviously going to phone the court to find out if theyre genuine first.
Then i thought i'd contact the local authority weights and measures to see if the cameras have been certified for accuracy by them.
Then obviously contest it on timings, that by parking they time the vehicle entering and leaving not PARKED, that i had no contract with them as i was not the driver and cannot confirm who the driver was, the fraud act... given that they are not the actual landowner and therfore cannot be a claimant as under contract law it is only the landowner that can apply for losses, that the losses/damages allegedly incurred are ficticious as the car park is free and returns no income and further harassment and intimidation.
I then thought about contacting the COOP to give them some grief covering the same points.
Then trading standards.

    You are correct that checking whether they are genuine ASAP is your first step.

    There is lots of info in the Sticky for Newbies thread so you should read that next and possibly look at The Parking Prankster's blog as he has some very cheap downloads that can be used as letter templates.

    No doubt the experts will be along soonly but they will expect you to have read the relevant part of the Stickies first and you will need to supply more info such as where in the UK this occurred. Also, scan a redacted copy of the letters in case you are saked my one of the more knowledgeable posters to supply one.

    If you have a look around you will find a few other people are in the same boat as you, so "nix panicus."

    Worry ye not. Couple of questions assuming that you wish to fight this:

    Was the claim issued via moneyclaimonline (MCOL) or from a local county court (in the case of CEL usually Barnet CC)?

    If the claim was issued via MCOL then you should be able to go online (using the details on the form) and acknowledge service of the documents. In doing so you should chose the option to defend the claim in full as this will buy you 28 days in which to file a defence.

    Do you have a set of documents issued direct from a local court? If so, then included will be a "Response Pack". Complete this carefully - ensuring your understand what it is you need to provide and ensure you get the necessary documents back to the court by - usually within 14 days. By returning the documents within that period you will have up to 21 days to file your defence.

    However - before you do anything take your self off and read the Newbies Thread. You may also wish to buy the Parking Pranksters guide (Amazon) which will walk you through the process - albeit for ParkingEye.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Ho87 CEL dont use MCOL they use the MCCC service in Salford its all paper based and manual

    Ive sent the OP a private message and will sort defence for them.

    They are not using POFA for these claims and I bet my bottom dollar the user has had a letter from "Debt enforcement action ltd"

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    can these new buzzwords please be added (with simple explanations) to the newbies thread please

    after yesterday I realise there is more to it than MCOL at Northampton due to the paper based one in Salford , Manchester being mentioned, also DEAL was mentioned in some threads too

    so I believe the small claims section needs some form of addition and tidy up because it mainly points to the bargepole explanation which is a year old now and I believe relates more to PE and Northampton Bulk Centre

    Whilst I don't know for sure, I suspect that this is the avenue KIFL is guiding these folks down with respect to their defences.

    There are no real new buzzwords to add - it will only confuse OPs more.

    The majority of court papers for parking companies do use MCOL - With CEL the return address is Salford and paper based.

    DEAL or Debt Enforcement Action Limited is also not worth adding - it is CEL's lastest DODGY tactic stating that the parking charge debt has been assigned.

    This latest influx of CEL court claims no doubt is a desperate attempt by CEL to scare people into paying - they do have a very expensive barristers bill to pay.

    CEL fold with a good defence and KIFL is the man for this.

    the OP,s are already confused, as can be seen in some of the replies too , some ask if it came from Barnet, others ask if it came from Northampton and yet more ask if it came from Manchester

    I replied yesterday to one and was confused by the bargepole link as its dated a year ago and I believe some of the info has now changed according to the reprints of the prankster books

    I also got "told off" by bargepole in another thread yesterday due to the wrong information being given

    so although I accept most of what you are saying, I disagree with you as some clarifications need to be made, even if its an extra link added to the newbies thread with the above info clarified, due to the fact that not everything follows the prankster guides or the MCOL procedures so the alternatives like the MCCC one needs some explanations too

    its alright for those "in the know" but forums are about explaining things and sticky threads are about explanations of commonly used phrases and acronyms etc, otherwise its pointless having them and pointless pointing people at them if the info isnt there or is out of date and not been amended (I have checked)

    so I see your point but totally disagree

    this thread could have all the explanations listed in one post in less than 10 minutes and then linked via the sticky thread seeing as a lot of it has been asked and answered

    intransigence wont help , so perhaps instead of all of you "in the know" telling the rest of us off (as has happened yesterday and again today) , try explaining it and adding it to the sticky thread instead
