Civil Enforcement LTD have now sent a Northampton County Court claim

Hi, I have been on this site about CEL 'PCN' that I received for parking in a car park in Sept 2012. The advice was to ignore. I did send them a letter initially asking them to justify their somewhat expensive parking rate (£2.90 Per min). They replied they didn't have to.

I have now received a letter from Northampton CC with a date of hearing 2nd July. Can someone please help me and tell me what I am meant to do? I've tried to read the sticky, but there is so much information on there, i'm not sure what is first.

    The first thing you have to do is read the Newbies thread Again but focus on Post 5 where it will talk you through the process you need to follow.

    There was no keeper liability before the POFA12. So if you are the keeper and the driver has not been named, you should have a good case. But this will binge on which day the act became law. I believe it did not take effect until Oct 2012, but guidance was issued from 13th Sept 2012, so I am a little unclear on that. An expert will soon pop in and tell you.

    I've just realised the date for your hearing. It's Tuesday. Oh my goodness, you must have been ignoring a lot of letters. I think you need to spend the weekend reading Prangstes guide to fighting claims. (Blue link on post 5).

    Just looking back at your previous posts, I see that you have posted a couple of times on other people's threads but never sought specific advice on your own situation and the advice given to others does not always fit all.

    Is this a Co-op car park? If so you need, in parallel to preparing your defence as per Section 5 of the NEWBIES sticky, to send a complaint to the Co-op.

    If you do a search on the forum using the search engine dialogue box at the top r/h side of the index page on 'CEL Co-op' you will see how others have dealt with this.

    Thanks for the replies so far.

    I received letter saying that CEL had changed Companies (or something simialar) I recieved a letter about the court action, but reading a thread at the time suggested that because this was Sept 2012, the advice was again to ignore.

    It's been a busy 6 months and things have got a little out of order.

    The NCC letter arrived today with a postal date stamp of 27th June and a Court Date of Service of 2nd July(does this mean the date they served the papers?)

    Yes co-op car park.

    I have received two letters since the middle of 2013 and they have both been received this year (one about the change of company and one about the court action)

    Hi,

    I'm in the same situation with a date of service of 02/07/2014 at Barnet Civil and Family Court Centre from CEL. (It was a co-op car park).

    The date of the alleged offence is 22/04/2012. I've always been told to ignore letters and this is what I have done. I've shredded the lot of them.

    I didn't think that they would take me to court!

    Is the advice I have read about pre Sept/Oct 2012 to ignore the letters and do nothing correct or not?

    If the advice is incorrect then is it too late to appeal or do I just read through the sticky and make an appeal?

    Angers, the court date of service is the date for which you have 14 days to respond. Visit the Newbie thread for more information post 5 on how to do that.

    Can you confirm the date of the original PCN please?

    Come on, you haven't got a hearing on 2nd July! You have got court papers - like lots of people with Co-op CEL tickets have seen off.
