Ok, I did everything that was advised by everyone on here and these are the results:
Defence was written by someone on peppipo - sent to court
Co-op letter written and emailed. They have refused to help saying it has gone too far if it's at the small claims court. and today emailed a satisfaction survey!
The court have sent me a Notice of Proposed Allocation to the Small Claims Track' with a Small claims mediation questionnaire document N180 enclosed. I have no idea what this means.
Would anyone be so kind as to help me through this next stage please?0 -
Do not take the Co-op brush off lying down, go into the shop and create a scene by the check outs, write to your local paper and radio station but best of all write to your local Trading Standards Officer(Council not Consumer Direct), suggesting that the PPC are trying to obtain monies from you by misrepresentation.

"Thank you for your patience in this matter. We have tried to get as much information from Civil about Court cases as possible but, unfortunately, they are unable to assist as this is with their legal team at this time. As with many other retailers, parking controls at our stores are managed by third party companies and the collection of parking charges is their responsibility. They have erected numerous signs in the car parks they control which provide details of the restrictions that are in force. The Co-operative Group appointed these companies to address the very serious issue of customers overstaying in our car parks and we did not take this decision lightly. As you have disclosed, there has been other correspondence sent out by the Car Parking Company prior to the Court Papers which have been received. There is a set appeals procedure for car parking charges. You should first appeal directly to the car parking company and if this is unsuccessful to POPLA (for charges after 1st October 2012). This is the Parking on Private Land Appeals independent service. They provide dispute resolution for parking charge notices. Unfortunately, we are now at a stage where the Co-operative Group is unable to intervene. If you still dispute this charge, you will need to submit a defence to the court. I do understand that receiving a Parking Charge is frustrating. I also understand you may feel that the Co-operative have let you down in resolving parking issues at this Store through Civil Enforcement, however, I would state that the current agreement in place means that we will not intervene on your behalf and confirm that this position is supported by both the senior management team and Executive under advise from our Legal Department. I regret to conclude by reiterating that we can be of no further assistance in this matter."0 -
your parking date pre-dates POFA 2012 so clearly that is irrelevant so CEL can only target the driver
COOP are jointly liable as they employed CEL at the time
just seems strange that the other cases seem to be being resolved by them, plus that last link had a name too
in any case, as court cases have been discussed on here and pepipoo dozens or hundreds of times and you were pointed at post #5 of the newbie thread and bargepoles synopsis and pranksters free book , never mind other posts I have read on here about the process I just thought you need to put some time in on this yourself, especially as you need to know your own case if going before a judge
nobody here can write it for you, you have to do the work yourself with guidance from what is on here and pepipoo , especially as the forum is a free service to all members
now if somebody replies who knows the process or has been through it then fair enough, go with it
in the meantime, whilst waiting for replies, go the self-help route by researching the topic as advised previously in this thread, plus read all the other similar threads for pointers etc , which you should have been doing over the last 4 weeks anyway0 -
I have been putting in the time, I just related to the two most significant things mentioned to me at the beginning. I don't expect anyone to do the work for me. I come here for help and advice as from what I can see, I am possibly the only one who has had coop refusal!
This is all a new language and recieving the letter from the court today had just confused me further. It isn't clear to those not in the know what it means, the terminology sounded like it was addressed to the claimant, not me! This is a very stressful time and I was just after further guidance, thats all!0 -
obviously its stressful, and obviously you need guidance, which I believe I provided (as did coupon-mad and others earlier in this thread) - you wouldnt be here otherwise
you said somebody else on pepipoo prepared the initial defence, so to me that means you arent doing it yourself but have others doing it for you
you asked about the N180 so I guided you to using the search box and post #5 of the newbies thread and pranksters court guide , so assuming you have done all of that you would know you need to fill in the N180 and I have just downloaded it from the MCOL website and fail to see how anyone other than yourself can fill it in ?

I havent been down this process so cannot actually advise you , BUT I have read numerous threads and posts and can assure you this has been discussed many times before on here and pepipoo
so pardon my skepticism but I dont feel you are doing the research and so far you have admitted that others have brought you this far so why take me to task over your own remarks ?
guidance on here is pointing people at the info required and telling them how to search the forum for it
I did both , so feel that was a good enough response to a member asking for guidance and I appear to have done more research than you have , so no evidence of due diligence
ie:- fill the form in (and I am sure I have seen posts by bargepole and coupon-mad giving a short summary of how to do this, plus I thought it was in the pranksters book) - do you disagree ?
I also fail to see how anyone else could fill those details in except you , but bargepole already posted his guide to completing an N180 on here some time ago , I remember reading it , so are you telling me that the first link in post #5 of the newbies thread doesnt link to the bargepole guidance post for an N180 ? - really ?
I would also advise you to check the MCOL website for guidance as well as using google with suitable search words0 -
I've come home today to exactly the same letter that I started this post with, except the dates are different , this one being the 12th August and they have slung another £35 on the charge.
Has anyone else had this? Any idea why this would have happened? IS this a normal event???0 -
