    That is why I questioned the date further down the thread. That was the date on it and dealing with legal papers is not something I deal with everyday, thankfully.

    I am working my way down number 5. I am about to start the letter to the coop as suggested.

    Does anyone know if CEL have won any cases yet?

    YOU DO NEED TO ACKNOWLEDGE THE CLAIM - STATING YOU WILL DEFEND IN FULL WITHIN 14 DAYS OF SERVICE - THIS THEN ALLOWS YOU 28 DAYS FROM SERVICE I.E. 2ND JULY to submit your defence.

    Nope the Co-op have paid them off each time the victims have rightly complained (it may take a bit of pushing to make the Co-op pay it off). You can see from post #5 'cases won' that CEL lost a case at Appeal this year (CEL v McCafferty, don't think she was at the Co-op but if she was, she's the only court case we know about) which will be one of the major cases for you to cite in your defence of course. Appeal cases are binding on the lower courts.

    Yes- to pay DEAL and I've received paper based copies. It does look like it is Northampton CC.

    I've been searching for templates to give some idea of how to complain to the co-op, but am having very little luck. Is it a brief statement explaining to the CEO that I am being harassed by CEL and an now being persued by the CC.....would he mind trying to support me and have the claim overturned................or do I need more detail???

    Give him the details of when the event happened, PCN number etc. Explain that as a customer you are being harassed and that you understand that the. Coop is not al all happy about customers being treated like this.
    You then request that he see the PCN cancelled. .

    You can also tell him that you have been treated so shabbily by the Co-op's agent (for whose actions they are responsible), that you are about to become a 'former' customer, alongside your family, and you will also be informing your friends not to take the risk of shopping at the Co-op for fear of finding themselves in a similar situation with CEL.

    But surely you don't need us to write your letter of complaint?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    What? CEL were/are the Co-op's agent so the Co-op are liable. TELL THEM TO CALL THE DOGS OFF. But normally the contact is not the CEO. There are dozens of threads about this, search this forum board for 'coop' or 'co-op' as keywords and you will find them all and how it panned out and who they complained to. Discussed also here:

    I take it you still have that DEAL letter as this could be useful to include as part of your defence.

    I can't remember off the top of my head the figure but it is something like of the original parking charge a request for

    £85 to deal????

    this is a scam change to DEAL as it is not an assignable debt like those under the CCA. However it could serve as a useful tool as part of your defence .

    In that allegedly the CEL "assigned" the parking charge to a third party retaining a small handling fee. Therefore if CEL has assigned the debt - (if you have the letter still) then the claim for the full parking amount can be deemed false and misleading.

    Even assuming that the debt were assignable section 136 of the Law of Property Act 1925 states that the assignment must be absolute i.e. you cannot assign only part of a debt it must be the whole debt.
