Then you did cut it fine; the 6th November was about the last day they would have accepted your claim under the "t&c" they are following - as opposed the the legal ones you are attempting to follow. Post number 5 on the thread I gave you before explains for future reference (it is my view you'll end up submitting the remaining claims and so need to know this). Post number 31 (think it number changed since I gave it to you before so have edited that post too) covers the LBA. Post number 1 may help you avoid making any more mistakes with future claims. There is no immediate rush to do the LBA. Obviously, you want to do it asap to get your first cashback and have the rest reinstated - OR should they be foolish enough to stick to their guns (which I really, really doubt!) to commence procedings on moneyclaim - at which point you are entitled to claim for the full whack plus court fees and statutory interest. Should THAT become necessary, accept nothing less than the full cashback (not JUST the first claim) plus the full court costs to date.
Your written English needs a little help for the letter; draft it and have a good read through to get it right. IF I have time AND this forum is working you can try sending it to me in a pm if you like, but I can only help if most of it is set out properly. It's also not an open invitation for everyone to do the same I'm afraid (sorry!). I hope my relevant post will help you.
Alternatively, if you have legal expenses cover on a home insurance policy it might be worth using that; they will will do this for you professionally at no cost, although it would take a while longer initially!0 -
and thanks for your comments on my written English, I will work on it . That is also why I want to wait until this Saturday to do the letter, first I have plenty time to think about how to write the letter, second I want to see if they will respond to my cash claim with the right bill.0

No harm in the latter and better not to rush the former. It is your last attempt to settle this without instigating a claim - though in fact (as I said) you are in a very good position if they force you to since you can then claim ALL the cashback in one go. You have not broken the t&c. An early claim does not negate your right to claim at the later (correct) time. Since you have not missed a claim nor sent in the documents incorrectly they have no grounds for refusing this claim - or future claims - under the t&c. Therefore if they do not reverse their decision within 14 days, agreeing to pay this claim AND reinstate your right to future, you will immediately make a claim to the court to obtain the money due to you under the contract. Should that be necessary you will, of course, claim for all the cashback which has been unjustly denied you plus court costs and statutory interest.

I had problem with e2save since they change T&C, I did not have problembs with them before. I doubt they changed cashback team lately. I should have sent them the bill which shows I have been connected for 4 months, ie the 5th bill, but i sent 4th bill which is the wrong bill and claim money one month early. received letter from them saying because i sent my claim too early, my future cash claim will all be rejected, which was nonsense as I read my T&C carefully that only when I send my claim too late that my cash claim will be invalid. sent letter to their complain dept defending myself and also sent them my 5th bill - the right one - before the closing date. yesterday I received a letter from their complain dept saying because my first claim was rejected, my future claim will all be invalid, my T&C only says early claim is only subject to £10 admin fee, not losing £420 for a 12month contract. It is going to be a long battle.:mad:

I am in a similar situation, I am going to send a letter to them, can you please confirm what is the correct address of their e2save complaints
department? the way they are operating is quite confusing, the letter that they have sent to me saying that the claim was sent too early does not have any address written on it, instead has logos of e2save, !!!!!!!!!!!!!!!!! and onestopphoneshop.co.uk and at the bottom it states a trading name of the carphonewarehouse.
I will not let them get away with this and take them to court if the need be, they are just finding excuses to avoid paying their part of the deal.0 -

I am on my 5th and final cash back , i had to send a cash back for one of my claims twice as they did not recieve it and royal mail seemed to have no record of it reaching. having used 2 vouchers in that month I now need a voucher for the last one.
Has anybody got a voucher in pdf format which I can print off which was issued in July 2007. I think it is the loughborough address.:beer::beer::beer:0
