Each scenario is different but passing someone on the inside, to pull out in front of them again is sometimes classed as inconsiderate because you've used a potentially dangerous maneuver to gain an advance on their position.
I don't work for the police or any legal times, i'm only relaying what i've observed on the other two forums above where lawyers and police officers regularly chime in their advice and experiences as well.
An undertake followed shortly by an overtake could clearly be classed as inconsiderate, but a simple undertake when there's no traffic in front can't possibly be inconsiderate.
Middle lane hogging, however, is always inconsiderate, unless people undertake. If someone undertakes a middle lane hogger then they are not inconvenienced in any way, but if someone has to move over two lanes to overtake a middle lane hogger, then they are inconvenienced.
However, in both scenarios, the middle lane hogger is not inconvenienced, because they do not have to alter their driving in any way.
I appreciate what you're saying and it depends upon the circumstances of each case. Most of the time I see middle lane hoggers meandering along when there's no traffic for hundreds of metres in front.. if you undertake someone in such circumstances there is no way an inconsiderate driving prosecution could be brought. Careless driving, maybe. I think the prosecution would be hard pressed to prove that as well though. What will your verse be?

Nah I addressed that in my post:
"Middle lane hogging, however, is always inconsiderate, unless people undertake. If someone undertakes a middle lane hogger then they are not inconvenienced in any way, but if someone has to move over two lanes to overtake a middle lane hogger, then they are inconvenienced."
Middle lane hogging = inconsiderate driving. What will your verse be?

I've seen lots of people prosecuted (well read about them) for passing on the left in certain circumstances, but i've not read about anyone being fined for hogging the middle lane yet (sadly)All your base are belong to us.0 -
He was in the wrong. The middle-lane hogs were in the wrong.
TBH, I've never seen anything that bad on my motorway travels.0 -
All those cars held up by Mr Toyota KW56 TTU...
9 cars all sitting there behind the Toyota. classic..
My thoughts on people using the US pit manouvre wouldn't apply in that case. Rocket lauchers. Or the driver must navigate a mine field whilst blindfolded.Censorship Reigns Supreme in Troll City...0 -

I usually see & experience this twice daily on my commute. Inside lane clear, middle lane someone doing 50mph (70 limit) and someone passing in the right doing 55mph with 20 cars behind them and me wishing the ability to teleport wasn't restricted to science fiction.
Along with that, there's a few NSL dual carriageways to and after the motorways. Sometimes you get people driving at 10mph under the speed limit for about 10 miles in the right hand side lane, never turning right or overtaking anyone. Then after the 10 miles they'll pull to the left lane to take a slip road off somewhere. All your base are belong to us.0 -
Why do you hog the middle lane? I hate you for it.
The middle lane is only for overtaking slower moving vehicles travelling in the inside lane so why oh why do so many drivers spend almost all their journey in that lane.

Errr... because lane 1 is full of trucks and people joining and exiting the motorway. Plus if we all drove in lane 1 what would be the point of the other two lanes? As long as you are not dawdling along I can't see an issue...0 -
There is a easy solution, make it an offence to be undertaken.
