    Please try to keep your emotions out of this and deal with facts.

    You are allowing them to get to you when actually they are just expending energy.

    There is no point second guessing their motives or feelings.

    Based on other threads (jellywobble for example) the POA deal with unsatisfactory management of affairs whilst the donor is alive but will decline to involve themselves once the donor is dead.

    In that case the step-mother used an unregistered POA after the deceased lost capacity to move money from sole accounts in the donor's name to joint accounts and sold sole assets and had the money paid into the joint accounts. The PGO declined to take action.

    As your brother is the other executor I would leave it all to him. If they contact you again tell them to only speak to him from now on. I think they see you as the weak link, whereas he is more bullish. Leave them to it!
  • Still ongoing, taken myself out of the equation and left the other executor to it. All copy invoices sent to Ugly sister, it took it 3 weeks to collect recorded delivery from the post office. We have given it a further 3 months and distributed the money as she has all receipts and accounts. We want to close executor account but unable to as sister has been igonoring all communication will not respond, or accept calls from my brother the joint executor.

    Any advise on what we can do? probate was granted a year ago next week.

    Why can't you close the account? You say you have distributed the money so what is left in the account - has the sister not cashed the cheque which was sent to her?

  • We sent all the account info/copy bills to all beneficaries, we were advised by our solictior all parties must sign to ammount. (We dpnt use this solictor anymore, he was a bit unsure of things we were asking him) All siblings signed to agree figures, then we had a letter from the ugly sisters solictors saying they were not accepting cheques all accounts had been verified! Think they were annoyed that my brother was ignoring their letters and sending all paperwork direct to sister via recorded delivery. Since September we've heard nothing so we have written cheques 5 out of 6 have cashed theirs. The ugly sister will not pick up the phone or respond to letters so because of this my brother (the executor thats taken full control!!!!) wont send her cheque, Ive said to just send it to her solictor with a letter, but he point blank refuses to go via her solicitor. He now claims he's been advised by another solictor that we have to go to court to get them to agree the figures? All a load of bull but can't talk to him anymore, totally unrational!! shouts and screams all the time. So I've left him to it.

    Very wise. As all the money has now be distributed, any legal action he takes would have to be paid for by him.

    It's been weeks now all 5 beneficiaries have cashed cheques but not heard from the 6th one (sister) or her solicitor, do we just do the cheque and address to the solictior? What's happens if it's not cashed is there a time limit, as I would like to close this account .
