parking eye prosecuting an 89 yr old who didn't need a parking ticket

    Hi all.
    He has not received anymore letters from PE but the last letter stating they were sorry (yeah right) for distress caused over a ticket he should not have received.It just shows that they don't give a toss really, otherwise they would have made sure that all action was stopped,immediately.The last letter he got was a pathetic attempt to say sorry,with spelling mistakes,and to inform him the ticket has been cancelled and the court summons but it may take time for the court to update their records.This company clearly show utter contempt for anyone daring to challenge them.
    The summons says both parties have 2 weeks before the court date to submit any additional paperwork in this case.The deadline for any fees to be reclaimed is 7 days before court date and if not fees will become non reclaimable.According to my understanding,PE stand to lose £35-ish in court fees.This is as much info as i have.If anyone could explain to me what i should do now.Thankyou.

    Think there should be a claim for the amount of time that has been incurred in order to defend the case (it will be time you and the carer have put in) + any expenses incurred (phone calls, letters, travel to see CAB).....I'll check with a "friend" tomorrow.

    Certainly, if you have not already done so, send full details to your local council Trading Standards Department. Do not trouble C.A.B. who will probably advise you to pay it.
    You never know how far you can go until you go too far.

    As far as I understood from friend you will need to create a schedule of costs to claim for:
    - Preparation time
    - On the day claim at least 90GBP for loss of earnings + expenses for defendant + any witnesses
    - Any other fees incurred

    Send a defence summary Monday morning or deliver it by hand to the local court (basically similar to the defence already submitted but with cases like CEL v McCafferty and ObServices v Thurlow attached - that you'll find on the Parking Prankster's blog online if you've seen it:

    and send a copy to ParkingEye as well.

    Include a copy of the letter from PE saying they've cancelled it. Then in the week of the hearing, phone up and ask if the case is discontinued or whether 'you' (ringing up as the defendant) has to attend or not?

    Which local court please? Maybe we have a local regular here who can help!

    And email the Daily Mail tomorrow but your priority is the defence to the court and PE - never mind the fact it should have been done the other day.

    Bump - I am concerned about this one - are you OK with all this?

    Have you put together a simple defence and witness statement (statement of truth from the driver) for the court and to send to PE? Contacted the Daily Mail?

    The court is in Coventry.I am just wondering what would happen if we ignore it all and as PE are very underhanded they might turn up and hammer him through default.

    @coventrian - the two threads you've opened on these are getting duplicate questions and answers. It would be better if you now confine everything to this one thread and let the other one slide down the forum, otherwise you might just miss something important.
