parking eye prosecuting an 89 yr old who didn't need a parking ticket

PE had already offered to cancel the case in return for £50. The response from the BPA Ltd doesn't confirm that PE will now be waiving that £50.
Exactly. At the risk of teaching my grandmothers to suck eggs....
Watch out for a 'without prejudice letter' (remember that cannot be shown to the court).
Also, a letter from PE cancelling the charge/case is not enough.... the court case must be treated as still live, and any directions or steps complied with, unless/until PE lodge a notice of discontinuance with the court, and (more importantly) the defendant receives a sealed copy from the court.
Finally I would love to think that the defendant in this case will be seeking an order for costs, and considering making a counter-claim for harassment under the EA 2010 (though realistically, in his shoes, I would probably want to put it all behind me and get on with my life).I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -

I have just emailed Steve Clark about this and got a very prompt reply:-

Lets hope that this is the caseWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

God, I love this forumOne important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0

Good result, sort of, if the above is correct.
However it should never have even got this far, who eveer it was/is that contracted parking eye should have put a stop to it as soon as they knew what was happening, assuming that they were informed.
If, so then theres probably still a media story in there, as due to the actions ( or lack of ) from the walk in centre this person has probably gone through a huge amount of stress, worry and anxiety.
Im not suggesting a financial penalty against the walk in centre, or whatever entity that allowed parking eye onto the car park, a full appology and not just re-assurance that this will never happen again, but action taken to make sure that it never happens again to anyone else, as well as disciplinary action against those responsible for allowing parking eye to infest the car park.
One way that the walk in centre could deal with parking eye is a Mk1 Bin bag and some tape to hold it on placed over the cameras. From the Plain Language Commission:

I am not surprised by PE or by the outrage, but I am surprised by the lack of sensible advice,
So what you got to say now?? This has got cancelled with the hard work of the people here and pepipoo forums, the people off this forum made complaints on behalf of this gentleman and it was cancelled!
I guess you will be issuing an apology now to everyone who has offered advice, I'm not having a go at you, but think before you post next time on here, we try and help everyone we can on here, we get through tens of thousands of posts here helping thousands and saving people money by doing so.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. Great news as far as it goes. The PE victim is clearly a fighter as is Coventrian. Well done for not caving in. It will now be up to members of this forum to take things further. PE (who we aren't allowed to call SCAMMERS or Scum remember) would have taken this all the way until, I suspect, this thread. I suggest a vendetta against Parking Eye.0

Wouldn't it be nice if PE offered a full apology over their actions and perhaps donated some money to a charity of the motorist's choice. I won't be holding my breath! What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

It is indeed great news and thanks to the regulars on here who spend so much time on and off forum helping people.
However, if a notice of discontinuance is not rece'd from the court within a week or so, I would send the cancellation notice to the court and ask for confirmation that the action has been discontinued. Or if the charge has not been formally cancelled by the PPC, then I would send a copy of the e-mails from BPA to the court with a short covering letter explaining who the sender is and the relationship to the Claimant via BPA, and ask the court to confirm that this action has now been discontinued.
I admit it - I am a cynic who likes to see the dots joined up where court proceedings are concerned!I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.0 -
Even though I emailed PE as well as the BPA the former have not replied to me. So I am getting all this information from the BPA. It just shows how arrogant PE are. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0
