Might be best sending Coventrian a PM, Ivor.

Hi Ivor.well,i'm not sure if he would be interested but it has turned out that parking eye have have only stopped the ticket, officially, but not the court summons. This means that he will be expected to attend the court date on 15th August. He is quite a frail man but he's doing alright.I would ask your advice if i may.how do i cost them money but get the court papers dropped?
Any help would be grateful because the 14 day limit of some kind will be up on 1st August.
    Thankyou.

Definitely in need of an urgent email to the Daily Mail as a start; I'm sure they'd love this, but it needs doing with ultra urgency to fit in with their campaign. What a 'scoop' for them to back up their daily articles.

In terms of expert advice from the forum, it would be best if the full up to date details were added to Coventrian's original thread, which will bump it back up the food chain here. It will be necessary to cross refer to the original information about the case.

As you have a correspondence from PE that they would drop cancel the PCN, I wonder if you can get the court to strike out the claim as vexatious, and ill-founded and put in a counter-claim for costs?

    See 27.6 (1) (c): http://www.justice.gov.uk/courts/procedure-rules/civil/rules/part27
The court may hold a preliminary hearing for the consideration of the claim:

"(c) to enable it to strike out(GL) a statement of case or part of a statement of case on the basis that the statement of case, or the part to be struck out, discloses no reasonable grounds for bringing or defending the claim."

Then at the same time am sure you can make a claim under the protection of harassment act 3(2).
On such a claim, damages may be awarded for (among other things) any anxiety caused by the harassment and any financial loss resulting from the harassment.

CAB might be able to provide directions if you guide them where you want to go...

  • My main concern is the health and welfare of an 89 (maybe 90) year old chap who obviously is having problems-still.

This probably overtakes my disgust for the people who are pursuing him, main priority here is taking the pressure off this guy once and for all, it seems to have been going on for an awful long time. His crime ? Presenting to an NHS facility with a cardiac problem.
