It was illegal to put MIL'S up for rent
On what grounds? Have they allocated the property to a new tenant who has signed the tenancy agreement, to your knowledge? Have they collected the keys or changed the locks now?
Advertising it ahead of the actual void, for example - is that what you are specifically challenging or other aspects of their management of it? Did your OH live there and so was entitled to a review to see if he could inherit the tenancy or had there already been a succession before?
What have they done differently from what the tenancy handbook or housing allocation policy says that they will do?
I don't have much knowledge in this area. The Shelter website for England says:-
By the landlord
To end the tenancy of a tenant who has died, a landlord must serve a minimum of four weeks’ notice on those looking after the deceased tenant’s affairs or on the Public Trustee.
By the person looking after the affairs of the person who died
If you are looking after the affairs of the tenant who died, to end the tenancy you must serve a minimum of four weeks’ notice on the landlord or ‘surrender’ the tenancy to give it up.....
...the tenancy is often terminated by mutual consent between the landlord and those looking after the affairs of the tenant who died.0 -
Hi bigaunty it was shelters solicitors that stated it was illegal as it was advertised before my MIL died
Getting the MP involved best plan ever.0 -
yes mel - and they were well aware of this, as they advised that the tenant hadn't vacated the property and to use discretion. That statement will seal their fate. it would be a different matter if MIL had ended the tenancy herself - but from what you say she most definitely didn't. and no relative had the power to do it on her behalf.0

Yep.
I think she's got to have hurt him at some point. He loooves grooming, likes the types of food he wouldn't eat, got carried in after a play out earlier when he didn't want to come in without scratching or biting.
Basically he's a really good boy.
