I feel left out as well, perhaps you could give him the link to the thread and let him PM us all :)
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

I don't know to what extent it is possible to misconstrue the statement that legislation changed as of 1st April and that RK liability now applies in Scotland. Methinks someone is having a wee problem with their memory. Perhaps as the result of having overindulged in battered Mars bars and IrnBru.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

First of all it genuinely is a "family member"..........not me. I am asking on their behalf.
The person has been known to me for many many years and I can confirm they are educated to a high degree and in their words did "absolutely not" miscontrue what was said to them.

How are they aware of this case?? I'm sure this isn't the only one in Scotland. There was no reference to where in Scotland etc. So how do they think they can identify which one it is? Unless............

Sorry if you miscontrued what I was saying. I was having a "pop" at G&N not your family member and the account you have provided is pretty unequivocal. It wouldn't be the first time that a debt collector has pushed the envelope in an effort to get one of their targets to stump up. After all, they don't get paid unless they collect the debt so "testing the limits" comes with the territory.

HO87, I didn't think for one minute that you were having a pop at my family member. I know that all the good folk on here are a band of brothers when it comes to fighting these........I'm lost for words as to what to call them!!!

I'd be interested to know how they think they have knowledge of this case just from my post? I can only assume that it was because my first post was accurate and not misconstrued at all!!!!

The only knowledge they can allegedly have of this case is based on the email I sent them (see my earlier quote) wherein I cut-n-pasted a section of your OP. G&N responded to my email with the exact words I quoted earlier. (I haven't replied again to them - yet).

I have not made them aware of this thread. That's not to say they haven't Googled and found it though. :)

    Just a wee update:
The man from Gordon & Noble did such a good job in putting the frighteners on my family member that they decided to pay the charge. I can hear you all shouting NOOOOOOOOOOOOOOOO as I write this.
They were scared of being taken to court etc etc. Although they had read all the advice on here, the nagging doubt was "what if I am the first one to be taken to court in Scotland"? "What if it does affect my credit rating and I can't get a mortgage". They then had a letter to collect from the post office, it was a letter with no stamp on and they had to pay £1.53 for the pleasure! Yes..........it was from Gordon and Noble.

I was going to say I don't know how they get away with this kind of practice, but now I do. I'm tempted to go to the car park where this originally took place, doing the same thing and wait for the confetti to come through the door. I'm a grumpy, cynical old woman and love a challenge!

And further encourages debt collectors to turn the harassment screws tighter.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Sadly, putting the frighteners on works all too often :(

If you do decide to give in to the temptation - when you get the call put them on loud speak and record them.
