parking eye county court claim

In fact I don't pick and choose who I help - I would write a defence for anyone if they've made an effort to understand their case/the basic legal issues. I have template/adaptable defences already written and could post one here - it also includes a request for the case to be stayed for POPLA instead. Then I tell people to follow up the DQ, once the case is allocated locally, with a letter to the local court asking again for a stay of the case, for POPLA to be undertaken instead.
3 posters this week have reported to me that the letter worked and their PE court claim has been turned into a winnable POPLA appeal case by their Judges, even after a hearing date was allocated. Same approach can be used for any PPC which uses POPLA, or IPC members where you'd have to re-word it to ask for IAS as the bespoke ADR for the industry instead. As long as it's briefly explained to the Judge they seem to like it at the moment in some cases as it spares the court's time as well.
I fear for an unsure appellant against a PE solicitor - and yes I know about all the wins against PE (but also I know that most still lose at the moment because most people can't defend well enough or go in and utterly miss the important points, or don't turn up). An unsure appellant would be like a lamb to the slaughter unless they got a bit of luck with a good Judge, we've seen it before. Better to force the case for POPLA and I don't want this OP to think a hearing is the only outcome. Several other possibilities are still open.PRIVATE 'PCN'? c-m,
Again, we see the hour you were up at, writing that post, along with so many others. Look at this: 'Last Activity: Today 2:27 AM '
Given that we know you work full-time AND do this on mse and pepipoo - probably other places for all I know, 100% knowledgable, persistent, thorough, encouraging, with other powerful behind-the-scenes support and liaison too.....well, it is hard to believe one person can do all of this.
But you do, Coupon-mad, day after day, Thread after Thread. As one person helped by you[and the whole community of mse Parking experts] I just want to knock right on the head any idea that you would pick and choose who to help. Collies Carer and I had already exchanged pms, CC slightly angered by any such interpretation.
That is why I post this now.
Part of everything we consistently see is a fierce quest for justice, generosity of spirit and up-to-date mastery[mistressery?:-)]of complex issues against the shape-shifting deceit and sophistry that is a private parking scumpany 'business model'.
The Newbies Threads alone stand witness to this.
C-m, ester, Gareth - EVERYBODY - if you want, you can count 21 posts C-m has already written today, since midnight, helping people who've found their way here.
Whether or not you knew this C-m....I suspect you don't even count them, but I have:-)
I see you posted 49 times yesterday alone, each post offering structured/ personalised/ linked/ annotated/ dedicated advice and help.
...which speaks for itself, even if your signature didn't:-).
We all want ester to win - be it by B&Q instruction to pe, by POPLA appeal, or in Court.
To salute C-m is not to lessen any iota of help from any other poster. It is simply to demonstrate the magnificent Community that mse is, how it CAN work - for everyone.CAP[UK]for FREE EXPERT DEBT &BUDGET HELP:

To be honest I pick and choose who I help , and I don't reply to a lot of threads because the advice has already been given and I have nothing further to add. But I think that some don't help themselves in reality, and I don't really help them because they've been rather stupid with it.
Everyone is different though, I don't simply tell people to go to the sticky thread if they have taken the trouble to create a thread, I like to give answers and ask questions too garner info, if given I give further advice. If people post and sod off then I don't normally offer anything else. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Or, if the poster is reasonably local, I will in some cases go to court with them as their lay representative.
Generally speaking (there are exceptions) I tend to give a wide berth to those who claim to be scared, panicking, or say they have received a 'summons' - such OPs are unlikely to have the nouse or the stomach for the battles ahead. As I mentioned on a thread on Pepipoo, the purpose of this forum is to fight back against the bullies, and that means, in the words of Sir Anthony Cecil Hogmanay Melchett, you have to be the kind of person who can take a hot buttered crumpet up the rear end without blubbing!
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
I am with the other 2 above. Going back a few months, before Umkomaas wrote his walkthrough and c-m followed up with her excellent sticky, we were going through Groundhog day time and time again helping those who couldn't take the time to read a few threads and were convinced that their case was unique.
It is encouraging to see how many recent threads have begun by saying they have read the sticky and other threads but have some other points to raise. I am willing to help them.
I am also prepared to help what I consider "interesting" cases as it is personally stimulating.
I quite often refer new threads to c-m's sticky as a first step because, apart from getting the flavour of what we are about on here, there is the helpful jargon buster.
The amount of help that people on here receive from the regulars is staggering - perhaps not in an overall context of the huge number of tickets issued, but it is growing and part of our deal with OP's should be
(a) if we have helped, come back and report the success
(b) if you win with our help, tell at least 10 people and refer them to this forum.
Obviously we are hopeful for a good result from Cambridge and if it goes our way, then publicity from that should go out, appeal pending or not.0
