Landlord sells property and wants us out

    if when the section 21 is issued the landlord failed to protect the deposit within 30 days or and failed to provide the prescribed information then the sec21 is void and so the possesion proceedings will be struck out.

    i am a tenant and this is what my ll failed to do.

    Did your LL take you to court over this?

    Complete turn around of things today!

    I got a call from the LL today in the afternoon. They say that on further reflect they will be happy to return our deposit and offer flexibility on moving dates as well!

    I know I shouldnt count my chickens before they hatch so will celebrate once monies come through!

    Do you suspect that, just maybe, they took an hour out from their busy, busy weekend to talk the matter over with someone, someone who might have had the slightest clue about the law and the LL's obligations?

    Just like you, I wouldn't break out the Champers yet, but I might stick it in the fridge to be ready...

    I do think they have spoken to someone in detail. Because they kept on repeating that once they return the deposit, would we send them in writing that we have received the deposit and will leave by 31st May.

    I'm not suggesting you do this (it's up to you of course, and what you think your circumstance is), but there is no real obligation on you to send them written confirmation that you'll move out on 31st May after you get the deposit back. Of course that'd be the honest thing to do if you promise this, but you need to get your own place sorted before you send confirmation of your move out date.

    Yes, I am hoping I will find something well before that. Fingers crossed! Tough, I will wait for the cash to hit my bank account before I get excited. The way our LL operates, it seems things can change on a daily basis.

    just to cover yourself - makesure you get above confirmation from landlord it in writing

    yeah the LL did and he had his claim dismissed

    the judge ripped into the LL for a full 15 mins and i had to stop laughing out loud as the landlord just wanted to get out from the court asap

    I think my LL has come to the same realisation. They are saying that the letting agency didnt guide as properly, and we are renting out property for the first time..... That was all good except when I first met them they said that they have a string of properties
