    I should disclose I am a BTL LL first.

    In this case the LL seems to be making a right mess of it, a lesson is in order, but perhaps not 3 times deposit and a collapsed sale with possibility of a penalty for not completing the sale.

    If you turn the screws fully on the LL what are the chances he will go bankrupt and you will find yourself turfed out by the mortgage company anyway.

    You have him over a barrel, negotiate something like, full return of deposit, good reference, LL to cover moving expenses and say 1K compensation (maybe more if one of those london 500K+ properties).

    Once you get that, find out if the new buyer is also a BTLer, maybe they will let you stay.

    I have already told the LL that I am happy to move out by the date they requested. All I asked was for them to return the deposit and thats it. I have not threatened to take them to court to seek the penalty or any other form of compensation. However, what I think that is happened is that they are an overseas LL who are not perhaps aware of the laws and regulation and are relying on the letting agent to guide them. They are ofcouse saying that everything is okay. The agents response is in post 41.

    Wrong. The fixed term did not end 19/03/2014. The OP has a 12 month fixed term and 19/03/2014 is the half-way point where if the LL had given sufficent notice before hand could have implemented the 6 month break clause but didn't.

    I don't know why you're being so hostile to the OP when it's the LL trying to breach the contract and the OP has agreed that they will move out by 31st May if the LL returns the deposit.

    The issue is that the LL and agent seem not to understand/accept their legal obligations. Or they understand them but are hoping to bamboozle the tenant into allowing them to circumvent those obligations.

    The tenant is struggling first to confirm their own rights, then to decide how best to respond to the LL in the light of thier rights, and the LL's bamboozling. (is that a word? If not, it should be!)

    The sometimes sexual, always hilarious act of taking a dump in ones mouth, and duct taping it shut on them.

    so nothing untoward then, just a bit of paper chasing, all legal and above board.
    op says he moving and will then need to address his deposit/bond.

    I think it will probably help me to add some more context to my relationship with the LL and their letting agent. The reason I started this thread was to confirm some queries regarding tenancy agreements, but to also find this out because I have little trust in either the LL or letting agent.

    Everything was fine until the day we moved in. I am talking of a letting agent that spliced together a contract. They took the signature page of the contract we signed, made some changes and attached it to another document and sent it back to us saying that this is our valid contract. When I pointed this out I was told this is common practice.

    The LL went back on written agreements they made. For example saying that water and heating was included in the rent and then saying that this wasnt the case, despite this being the case in the advertisement for the property and the agent confirming this in writing.

    I get up to loads of stuff that is common practice, for me at least.


    so why have you let these things slide until now, or did you get sorted out with the utilities bit.

    I moved in at the end of September. I went back and forth until December about the utilities. Early Jan I was told that they were "thinking" of selling the property. I continued discussing the contract and other issues with some long periods of silence where a couple of weeks would pass with no reply. Now they have said that they have sold the property and I am receiving a barrage of emails.

    There are laws about misleading adverts - but it is besides the point.


    Did they manage to sell the property with no viewings, if there were viewings you should have known, don't tell me they just went in and did viwings without your consent.
