    Well, I work in the hospital, and it's a hospital car park. I have a valid permit to park there. I have already appealed to them, so they know I'm the driver.

    An appeal has already been sent in though, so too late to change from I and all that
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I've posted the appeal to York Hospital, PCN as well as BPA. Let's see what they say.

    Received another response today:

    Dear XXXX

    Thank you for your e-mail.

    Roxburghe are acting on behalf of their client York Teaching Hospital.

    The Hospital are only members of the British Parking Association and not the Approved Operators Scheme (AOS) and therefore do not adhere to our Code of Practice and cannot offer POPLA the independent appeals service.

    As you have appealed your parking charge notice with the operator and had it rejected there is no other appeal service available.

    The BPA is a membership association and not a regulatory body and we do not have the authority to instruct the parking operator to cancel parking charge notices.

    Roxburghe are the Debt Recovery Agency that the hospital are using to recover outstanding parking charge notices therefore this is the reason why you are now receiving letters from them requesting payment.

    We do suggest that you take this issue up with the hospital directly and explain your circumstances.

    Just ignore the junk mail like everyone does. Search the forum for 'Roxburghe', they are not worthy of any response. Read other threads.

    But keep on at the Hospital and PALS to cancel the annoying drivel.

    it seems you have missed the point here, so lets spell it out in simple terms

    the debt collectors cannot take you to court ! - period

    the creditor may try to do so, ie:- your PPC which is actually PCN Parking Services

    but actually only the landowner or his legally appointed agent can take you to court - the one who has locus standii - legal standing

    so are roxburghe any of the above ? I think not

    I think a complaint to the dvla is also worth doing with all this correspondence, because they are getting your dvla details but nobody is offering ADR via POPLA , so in my opinion your rights are being infringed

    this is one of the reasons we always mention never revealing the driver on the day, I appreciate they may know this from the trust having it on file though

    seems a strange one to me , so best bet is to get the trust to cancel them, or to make their life hell with FOI and other pressure points etc , the reason booting of PE was caused due to too much hassle for the trust when it came down to issues like these

    some trusts are even booting out the PPC if they have one, although in this case there doesnt appear to be a BPA AOS ppc in operation, but as you seem to have appealed within 28 days then your appeal should be dealt with

    otherwise it could be a wait and see for an LBC or court papers , then deal with it
