    I think it's going to be the trust themselves running the car parks at this hospital, they then hand it to roxburghe. Which as I said should be complained about. They don't appear to have a parking policy which is public, checking a foi request in 2009 doesn't actually reveal that.

    This hospital and nhs trust should have some very pointed questions asked about this issue, it may be worth doing a new foi on this.

    This is the letter I've typed, to send to PCN Parking Services (or York Hospital), with a copy to BPA and DVLA. Any suggestions?

    Dear Sir / Madam,

    The purpose of my letter is to ask you to cancel the following PCNs (please note I have a valid staff parking permit no: ):

    PCN No: Issued on 20/01/2014
    Reason: There were no clear signs to indicate I wasn't allowed to park there. The entrance to the car park prohibited parking for visitors only, and I ensured I was not parked on the 4 bays in front of which "Parking for Neurosciences only" signs were displayed. I was not told at the time of issue of permit about which parking spaces am I allowed to park in, and this car park looked like any other.

    I received a letter dated 12/03/2014 (received 11 days ago) rejecting my appeal, and further received a letter from Roxburghe dated 31/03/2014 (less than 4 weeks later) demanding that I pay £98.

    PCN No: Issued on 22/01/2014
    Reason: I did not receive any letter accepting or rejecting my appeal. Roxburghe confirmed to me on the phone that they had indeed received my appeal in writing. I have directly received a letter from Roxburghe dated 31/03/2014 demanding that I pay £98.

    PCN No: Issued on 25/02/2014
    Reason: I was on call that day, and left a note on the dashboard explaining the same, including my contact details. I came into work more than an hour before my shift started, to find a parking space. I had to leave my car in a safe place to start my shift. My on call involves leading the cardiac arrest team. I also attended a cardiac arrest call within 5 minutes of me starting the shift. Obviously, patient care would have been compromised for want of a parking space.

    Roxburghe tells me that the car park is not under BPA, and so I have no right to appeal to POPLA. I find that hard to believe, as the letterhead from PCN Parking Services has a logo confirming its a BPA approved operator. Is the logo purely designed to mislead then?

    The Healthcare charter clearly states to ensure that any enforcement of parking terms and conditions is:
    a) Fair, reasonable and legitimate
    b) sensitive to the needs of people using the healthcare facility, and does not cause unnecessary anxiety for drivers and their passengers
    c) carried out by members of the BPA Approved Operator Scheme or a local council using its regulatory powers.

    Surely, BPA's healthcare charter guidance isn't being followed at all?

    You have two options from here:

    1) Cancel the above PCNs

    2) Issue me a POPLA verification code so I have a fair chance to appeal.

    Roxburghe won't cancel anything because they cannot, the only ones who can cancel this is the trust themselves. These debt collectors will either fob you off or just ignore you.

    This is where you can send a foi to the nhs trust, I suggest that you add on a few questions from us as well on the request if you are going in that direction, will think of a few this afternoon for you.

    My appeal was rejected by PCN Parking Services. I think I'll send to York Hospital, with a copy to PCN and BPA.

    How many days do BPA approved operators have, to communicate its decision regarding rejecting an appeal?

    They have 35 days to either accept or reject an appeal. Further communication regarding the letter of rejection is not covered, so they will either ignore your communication or mention it and demand money. This situation is not a race though so don't worry about you meeting deadlines.

    I am concerned you are showing yourself to be the driver which isn't what we advise at all. You've said stuff like:

    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
