    Hi one and all! I'm a bit concerned, about all this court bundle stuff. DH is due at Bristol county court on 6th Aug. In his letter from the court it only says;

"the original documents shall be brought to the hearing"

there is no mention of court bundle and also in the previous letter from the courts we didn't have to fill out the allocation questionaire either.

I know I'm clutching at straws here, but do you think this means the judge could be in our favour?

A "court bundle" is purely what the judge asks you for ... be it just your schedule, or all your correspondence, legal papers, settled cases, etc., etc. So, in your case, your "court bundle" is just the original documents ... that's everything you've received and sent to do with your case ... no copies and nothing extra. Many people perceive it to be long and complicated, but this is not always the case, as in your caseicon7.gif

Judge's directions seem to have got simpler on the whole ... my bundle was 230 pages long, complicated and took an age to prepare.

You're lucky .. not seen these directions before from a judge but, yes, it looks as if he's on your side and knows that the bank are highly likely to pay up before court.

You will of course have to get everything in date order and make sure you fully understand everything, but should be pretty straight forward.

Incidentally, I had no AQ either, though I had to pay the fee as my claim was for over £1500. This is getting quite common.

Count your blessings ... and best of luckicon10.gif

  • I am really sorry to start a new thread, but I am going stir crazy trying to find what I need.....
I have a court date (Small Claims Track) for the 22nd Aug. I need to get all documents to every other party 14 days prior.
This claim is with HSBC and the solicitors (DG Solicitors) have no email address and a telephone number that has a stupid message. So they are no help !!
I understand that I need to send in copies of statements and correspondence leading up to this moment, but what else?
Is there anyone else who has gone past this stage?
    Please help, slightly worried now.....

LOL Moonflower ... how long's a piece of string?! They have their own "rules" which they make up as they go along. Hang on in there, more offers will comeicon7.gif

See below ... hang on in there, you WILL get your money, they don't want to go to court!

Court date next Wednesday, judge has Judgement Form and Wasted Cost Schedule dropped off yesterday and what happens a few hours ago ... email from Wragge offering FULL AMOUNT, INCLUDING ALL COSTS!!

They say payment within 28 days, so rang them and said want a cheque by Monday (postal strike?!). Not until a cheque arrives and it clears will I ring the court to cancel Wednesday. Obviously it won't have time to clear, so will ring the court to ask advice when cheque arrives. Possibly ask for a "stay" or adjournment, or ring them when it clears.

Wragge will ring Monday and said, if I don't get it in time and it has to go to court, they'll send a rep. with their "acceptance" letter to show to the judge. Whatever, I now have it in writing, so plain sailing!

Can't believe it after over 7 months ... in shock sport-smiley-001.gifsport-smiley-001.gif
