My partner and I are in the process of buying a home together. It is my first home but he already owns 2 properties. Currently he lives in one and the other is rented out. The flat he is living in now will also be rented out in the near future as we are just in the process of changing it to a buy to let mortgage.We have been sent an invoice from our solicitor's today stating we will still have to pay £5.5k stamp duty and we were so disappointed as we thought the stamp duty holiday it would apply to us.Can you answer this for me... if both of his properties are rented out does the stamp duty still apply to us? or even if the flat is not rented out currently but will be in the near future can we claim the stamp duty back if we pay it now on the new house? It is all so confusing. Also all the properties are below £500k.Many thanks0

They are uncapped and, if you are not happy with the "service" and refuse to pay once you have bought the house ' they can LEGALLY take your house! This is a massive scam and AFAIK not many are aware of it + the estate agent was definitely NOT forthcoming when I asked about it ) .
