  • Anything that obstructs free passage along a highway is an offence - wheelie bin, parked car, etc. - s.137 Highways Act 1980.

    I would have said that S148c would be a more apt section.

    Penalty for depositing things or pitching booths etc. on highway.
    If, without lawful authority or excuse—
    (c)a person deposits any thing whatsoever on a highway to the interruption of any user of the highway,
    he is guilty of an offence and liable to a fine not exceeding level 3 on the standard scale.

    Many years ago we had some neighbours move in and start sticking cones outside their house. Problem was they had 2 cars and the old style terrace houses were not wide enough for 2 cars. So the cones moved.

    I would just reverse and push them out the way or throw them into their garden.
    Slowly the cones started to vanish though.

    Its nice to park outside your house, But its not a legal right. Its the highway anyone can park there.

    Pop the bin into their garden. Tell them the traffic warden was going to give it a ticket :)

  • or call the council and say theres a spare refuse bin in the road. it will soon be collected.

    You need a road closure notice from the council to put a skip on a public highway , don't see why this would be any different

    I would have said that S148c would be a more apt section.

    Either could suffice, it would be easier to show that something like a wheelie bin or a parked car was causing a physical obstruction, rather than than just an interruption.

    A level 3 fine is up to £1000. Instead of quoting a maximum fine for offences, now they are set at different 'levels'. When they want to increase fines, all they have to do is increase the amount of the level, rather than having to amend all the different legislation relevant to the offences.

    Just wait until he has gone out and fill the thing with fast-setting concrete. Then have a good laugh watching him put his back out as he grabs the bin and tries to tilt it back before realising rather to late that the bin is heavier than expected.

  • My neighbour has taken over half the street.

    His garage is full of junk, and there's a car parked in front of it. The shared drive is full of sleepers, bricks, wheelbarrows etc., with another car and a skip at the end of the drive. There's a car parked on his front garden, another in front of his house, another in front of my house, and his work van across the end of the drive. I can just about get a pushbike in and out. The mower blade has got dents in it from the car parts discarded on my front lawn.
