What I mean is I will pay a solicitor to represent me.
I don't think the solicitor will get me off.
I hope the solicitor will negotiate on my behalf and avoid me getting a jail sentence or a criminal record.

            I may be wrong, but if the council knew you were self employed, did they not ask for regular income details? I know HB can be challenging with fluctuating income so thought they asked for details every 3 months or so...were you self employed when you first claimed?0

I would love to do this on your behalf, just in case you forget ; ) what with your messy books and your husbands forgetfulness in losing payslips and you not getting round to doing things, my goodness, how do you survive

            First of all make sure you email them now (not tomorrow when they open, now) to tell them your circumstances have changed & you will provide the proof ASAP. Don't leave it another week and let the overpayment get bigger.
I have been and still am a benefit investigator (since 1992) so feel I know what I am talking about. On the face of it you have committed an offence, you have failed to report a change in your circumstances which you knew would affect your benefit. The question of dishonest intent is a separate one. You may have mitigation but the offence is still that of failing to report a change.
Nobody can say they will get you off or prevent an interview taking place- that is a decision taken by the council based on the information available to them. This guy on the internet can not promise you anything. Does he charge for these "excellent results"?
I suggest that you consult a proper solicitor - one that is qualified to advise or represent you.
Most of all I suggest you don't let it drag on. Tell them. Now0 - 
            Just looked at this again. O/p have you made any contact with the council? All you need to say at this stage is that your self employed income has increased and you are getting your accounts together. They can then suspend your claim to prevent it getting worse.
If my last post sounds harsh, I apologise - my intention isn't to have a go at you. It's clear you are taking steps to put it right, which is a good start.0 -

Hi,
I am a 51 year old white english male, unfortunately hetrosexual, with no disabilities. I have a mortgage and small amount of savings over £16k.
I have no dependent children other then two 20 year olds at University who I pay out rent for, one is a student nurse with a £4000 per year bursary and is expected to live on that.
I have worked every day since I was 15 and now feel after 36 years of work, I want to spend my time in the garden, going to the pub and getting !!!!ed, with no worries about getting up 6 days a week to go to work.
What benefits can I claim ? A genuine request for info.
I have paid into the system for 36 years and Never drawn any benefit of any description? I feel isolated and marginalised. Am I being discriminated against or can I claim anything in order to fulfil my dreams of sitting at the Red Lion from morning till night like many other fine fellows ?0 - 
            Thank you for eventually letting us know that you are OK, though it seems strange that you were all set to go to the Council on Monday morning and then, on the strength of "a guy on the internet" who promises the moon, decided not to.
Be honest with yourself, he's not going to do this for nothing, nor is he going to say that he's not that great at his job, even if he isn't! As others have said, who know far more than I do, at the very least you should contact the Council, explain you're self employed with a fluctuating income, and that you're in the process of having your accounts checked, and could this be noted on your claim, and then contact a proper solicitor.
Incidentally, if you've never used the services of an accountant to audit your business, how are you getting accurate figures in order to file your tax returns, and pay the correct amount of Income Tax?

            To whoever asked how I survive if we are so disorganised: paying all the bills by direct debt.
Re my tax returns: it is a very small business and I have the income paid into my account so that is easy to track. Unfortunately I did not file the returns properly, I could have had so many discounts, percentages of my rent and all the other bills and more and never did it.
Yes of course the solicitor will charge. There are many websites on the internet full of solicitors offering their services.
